Gym Kids, Inc. Waiver & Release
We, the staff of Gym Kids, Inc., recognize our obligation to make our students, parents, and guardians aware of the risk and hazards associated with gymnastics, tumbling, cheerleading, dance, physical conditioning and even "Parent/child or Guardian/child supervision" of preschoolers at Gym Kids, Inc. Gym Kids Inc. students and even supervising parents may suffer injuries, possibly minor, serious, or catastrophic in nature. Gymnastics, tumbling, dance, stretching, cheerleading, stunting, running, jumping, sprinting, physical conditioning, trampoline exercise as well as walking on the uneven surfaces and participation in parent child classes can be dangerous and can lead to injury. Parents should be aware and make their children aware of the possibility of injury and encourage their children to follow all written, posted and verbal safety rules, progressions, and Gym Kids, Inc. coaches' instructions.
Gym Kids, Inc., its coaches and other staff members, will not accept responsibility for injuries sustained by any student or parent during the course of gymnastics or cheerleading instruction classes, tumbling, dance, conditioning, exercise, cheerleading, stunting, running, open gyms, or in the course of any exhibition, competition, or clinic or while traveling to or from any event. I fully understand that the Gym Kids, Inc. staff members are not physicians or medical practitioners of any kind.
With the above in mind, and being fully aware of and appreciating the risks and possibility of injury involved including the risk of catastrophic injury, paralysis, and even death, as well as other damages and losses associated with participation or supervision in gymnastics, tumbling, cheerleading, stunting, open gym, exhibition, activities, clinic, or competition, in which he or she may participate or while traveling to or from any event, I consent to have my child/ren participate in the programs offered by Gym Kids, Inc.
I hereby release Gym Kids, Inc. and Gym Kids staff members to render temporary first aid to my child/ren in the event of any injury or illness, and if deemed necessary by the Gym Kids, Inc. staff members to seek medical help, or call a doctor, including transportation by a Gym Kids staff member and/or its representatives, whether paid or volunteer, to any healthcare facility or hospital, or the calling of an ambulance for said child should it be deemed necessary.
I, my executors or other representatives, agree that Gym Kids, Inc. and the sponsor of any Gym Kids, Inc. event, along with the employees, agents, officers, and directors of these organizations shall not be liable for any losses or damages occurring as a result of my or my child's participation, except where such loss or damage is the result of the intentional or reckless conduct of one of the organizations or individuals identified above. I, my executors or other representatives waive and release all rights and claims for damages that I or my child may have against Gym Kids, Inc. and/or its representatives whether paid or volunteer.
I also affirm that I now have and will continue to provide proper hospitalization, health, and accident insurance coverage which I consider adequate for both my child's protection and my own protection. I also understand that it is the parent's responsibility to warn children about the dangers of competitive sport and injury potential. I will remind my child of the dangers before every practice and competition according to what the parent feels as appropriate. Gym Kids, Inc. will warn the child through repeated verbal "Safety Messages" and our teaching style and progressions.
As legal parent or guardian of this athlete, I hereby verify by my signature below that I fully understand and accept each of the above conditions for permitting my child to participate in classes, events, competitions, and activities conducted by Gym Kids, Inc.
Gym Kids, Inc. Rules & Policies
Gym Kids, Inc. is committed to provide the best learning environment for each and every student. The following "Rules & Policies" are written to indicate the enrollment periods, customer conduct, and assure efficient management so that each child can receive safe and effective instruction.
Tuition payments
Monthly tuition payments are due by the 20th day of the previous month. For example, the February tuition is due by January 20th. Each payment covers one month regardless of how many classes fall into that month. The occasional 5th week of the month will count as a make up toward holidays that fall on week days. Students will not be allowed to class with over due tuition.
Preferred payment method is the monthly electronic payments from your bank account to the Gym Kids, Inc. account. The E payment set up need to be done with your bank. You will need Gym Kids, Inc.'s banking information, and the date of withdrawal. Our usual payment methods are still available; cash, check or money order. We do not accept credit or debit cards at this time. Penalty for returned checks is $35.
Withdrawals
Tuition payments for classes are paid monthly. If for any reason the family decides to discontinue a class, simply email to gymkidsinc@gmail.com by the 20th of the month prior to withdrawal, and we will remove your child from the class. However, tuition payment will be due if we do not receive your withdrawal notice by due date.
Credit / Refunds
We do not offer credit and/or refunds for cancelled classes due to holiday, vacation, illness, weather or any other reason. Gym Kids, Inc. does not issue refunds.
New students may sign up at any time during the year, and receive a pro-rated tuition fee for the balance of the current month. Gym Kids Inc. is unable to guarantee availability of a child's space without payment!
Make-Up Policy
Students are expected to attend their weekly scheduled classes. As a courtesy we allow one make-up per month. You must contact Andrea by email @ gymkidsinc@gmail.com before your child's scheduled class to inform of your child not attending to receive the make up class. Make-up must be scheduled within four weeks of the missed class. There are no make-ups for missed make-up classes. No credits or refunds will be given for classes not made up.
Uniforms/Attire
For hygienic and safety reasons, bare feet, stockings and street shoes are not allowed in the gym. Each student must wear clean, white gymnastics shoes for class. No jewelry, hoop earrings, jeans, belts, buckles permitted. Hair must be tied away from the face. The gym's cold weather temperature is set at 65 degrees. In cold weather children should wear sweats over their leotards. Warm-up gear may be removed as necessary. Gym shoes may not be worn outside. Valuables & other items should not be brought to the class. Gym Kids Inc. is not responsible for any lost/missing items.
Classes will start and be dismissed on time. For your child's safety, do not drop-off or pick-up students more than 5 minutes before and after their class. Please have children gather for class in designated student waiting room area. Gym Kids instructors are unable and can not accept responsibility for children who are dropped off early and not picked-up on time (unless it is previously arranged by the parent).
Food, drinks and gum are not permitted in the waiting room and within the gym.
Parents & visitors are generally distracting to young children in class and interfere with instruction. Parents will remain in waiting area and refrain from making any communication with children during classes. For safety reasons, (1) Do not attempt to communicate to your child while they are in class; (2) Siblings are not permitted in the instructional area at any time; (3) Children are not authorized to play in the gym or on equipment before or after any class or party.
Electronics
For the privacy of our students and their families, no photographing and/or recording is allowed on Gym Kids, Inc. premises. The use of electronics are not permitted for students during class time, to include cell phones.
Membership & Participation
Gym Kids, Inc. reserves the right to cancel a student's membership at any time. Disruptive and / or potentially dangerous children will be removed from class until they are able to safely participate.

Covid-19 Assumption of Risk & Waiver
Assumption of the Risk and Waiver of Liability Relating to Coronavirus/COVID-19
The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, have laws controlling the congregation of groups of people.
Gym Kids, Inc. has put in place preventative measures to reduce the spread of COVID-19; however, Gym Kids, Inc. cannot guarantee that you or your child(ren) will not become infected with COVID-19. Further, attending Gym Kids, Inc. camps and/or other programs could increase your risk and your child(ren)'s risk of contracting COVID-19.
By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COVID-19 by attending Gym Kids, Inc. and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at Gym Kids, Inc. may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Gym Kids, Inc. employees, volunteers, and program participants and their families.
I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with my child(ren)'s attendance at Gym Kids, Inc. or participation in Gym Kids, Inc. programming ("Claims"). On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless Gym Kids, Inc., its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of Gym Kids, Inc., its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any Gym Kids, Inc. program.

Protocol as of August 28, 2020
The Purpose of the Safety Plan
This document is designed to help prevent the spread of COVID-19 and adhere to the current New York State and Department of Health (DOH), Center for Disease Control (CDC) and USA Gymnastics guidelines. The Safety Plan will be retained on the premises and made available to the New York State Department of Health or local health or safety authorities in the event of an inspection.
BUILDING PREPARATION
Sanitizing/Disinfecting
The facility has been disinfected and sanitized in preparation for 'return to work' using approved COVID-19 products.
• Every mat has been cleaned
• Every piece of equipment has been disinfected
• Carpeted areas have been sterilized
• Foam pit has been emptied, cleaned and covered with a tarp
• Storage cubbies have been disinfected
• Waiting room and both bathrooms have been disinfected
• Signs are posted to remind staff, students and families to adhere to proper hygiene, social distancing rules, appropriate use of PPE and cleaning and disinfecting protocols
Entry/Exit Doors
The main entrance doors are the only entrance for gymnasts. The side door will serve as the exit at the end of class. The front doors to the waiting room will now be the check in site for Student, Staff and Parent Screening.
Waiting Room
All items that have been previously shared have been removed from the waiting room. Doors and surfaces have been disinfected. There are 6ft markers on the floor where parents can stand for observation. The capacity in the waiting room is limited by the proper 6ft distancing.
Cooperation of Families, Students and Staff with the Safety Plan
The Safety Plan is designed based on current federal, state and local regulations and guidelines, and will be modified as new industry specific guidelines are presented. The Safety Plan exceeds all safety guidelines and requires the cooperation of all who enter the facility. We understand and respect families who make the difficult decision to delay their return until they are comfortable or policies in the Safety Plan change.
Our goal is to protect the health of our staff, students and families. Gym Kids, Inc. will be enforcing all safety protocols as described in the Safety Plan. Any staff, student or family that is unable or unwilling to follow these protocols will not be able to attend Gym Kids, Inc. until policies change or they are willing to follow them as described.
All of us must do our part to maintain the health and safety of Gym Kids, Inc., our families and our communities.
Staff is responsible for adhering to, enforcing and explaining the Gym Kids, Inc. Safety Plan. They are responsible for their own health, travel and leisure activities and must report any health changes to Gym Kids, Inc. for proper documentation. Staff will be required to wear a facial covering at all times in the gym. If spotting is necessary, gloves will be used. Staff will be responsible for following cleaning protocols, maintaining 6ft distancing rules, keeping a cleaning log on their events and sanitizing their events after each rotation and at the end of class. No outside shoes are allowed in the gym.
Gymnasts/Students are responsible for following the guidelines, Safety Plan and directions given by coaches and staff. They must voice any concerns, questions or injuries/health issues that they may be experiencing to the staff.
Families/Parents are responsible for making sure their families follow recommended health hygiene requirements and the Gym Kids, Inc. Safety Plan. They must report any health changes or exposure to Gym Kids, Inc. All who enter the facility must pass the Health Screening and all entries to the facility will be documented.
GYM KIDS, INC. PROCEDURES
Gymnast Check In
Check in will begin at the front door. A mandatory Health Screening will be required to enter the facility.
• Parents will park in the parking lot and wait until their child has passed the health screening and entered the facility before leaving the premises.
• STUDENTS will exit the vehicle and line up on the sidewalk on a designated 6ft marker, wearing a face covering and carrying their gym bag. A parent may accompany a young child to the line, if needed. However, parent can not enter the facility until students are checked in and entered to gym.
• Gym Kids, Inc. staff member will individually perform the mandatory Health Screening when each child reaches the front door. Health screening google form must be completed before each class:

• Student must be wearing mask.
• We will be checking temperature upon arrival with a touchless thermometer. No one with a temperature of 100.4 or higher will be admitted into the building.
• Student will sanitize hands with hand sanitizer provided at the front door.
• Student will enter the facility and change to their gymnastics shoes on designated marked spots in the waiting room, before walking onto the gym floor. Personal belongings (shoes, coats, jackets etc.) will be placed in the back packs.
• Social distancing of 6ft will be required by both staff and students.
• Student will be guided by staff to enter the gym, put their face mask in the paper bag in their gym bag, and place their gym bag on a designated marker.
• They will wait on a 6ft spot on the floor until class starts.
• If parents would like to stay on the premises after drop off, they may stay in a designated parking spot. Questions or requests should be emailed to Coach Andrea at GymKidsInc@gmail.com.
• Gymnast backpack should include the following items, individually labeled:
o Face mask (to enter and exit the building, as well as use the bathroom)
o Brown paper bag to place face mask in
o A water bottle (the water fountain is closed down).
o One block of chalk placed in a plastic container or zip lock bag (team gymnasts only). We sell chalk $3.5 / block.
o Athletic tape
o Individual hand towel
o Grips (if used)
o Bandages
o Hair ties
o Hand sanitizer (unless your child is not ready to carry hand sanitizer, in which case please inform Coach Andrea)
o Extra pair of white socks
o Extra leotard
o Tissues
Warm Up
Warm up will start at the beginning of class with students spaced 6ft apart on the gym floor. We will begin with stationary cardio, conditioning and stretching program. After warm up each student's 6ft marker will be disinfected by staff.
Restrooms
When gymnasts need to use the restroom, they will notify the coach, put their mask on and use the bathroom, while maintaining social distancing. Students will be reminded to wash and sanitize their hands. We keep a log of each time the bathroom is used and sanitized. Gymnasts will return to their event, remove their mask before resuming activities.
Coaches will remind students of proper hygiene, hand washing and social distance requirements. Lesson plans are modified to omit partner activities and limit the use of props.
Parents Observation

All entries to the facility will be documented. Parents are permitted to observe from the waiting room while complying with 6ft social distancing protocols - only after all students are admitted to class. There are 6ft markers on the floor where parents can stand. There is limited capacity and parents will be asked to voluntarily switch out with another parent when capacity is reached. All families must pass the mandatory Health Screening before entering the facility, comply with social distancing and wear a facial covering.
