ASSUMPTION OF RISK
RELEASE AND WAIVER OF LIABILITY
INDEMNITY AGREEMENT
IN CONSIDERATION of allowing my minor child/ward to participate in the programme, related events and activities of Sky Athletics Ltd.
I WARRANT TO YOU THAT:
1. I am a parent/guardian having full legal responsibility for decisions regarding my minor child/ward, and
2. I am familiar with the risk of serious injury and death which any participant in this programme must assume, and
3. I believe that my minor child/ward is physically, emotionally and mentally able to participate in this programme, and that
his/her equipment is mechanically fit for his/ her use in this programme, and
4. I understand, and will instruct my minor child/ward, that all applicable rules for participation must be followed and that at all times the sole responsibility for personal safety remains with my minor child/ward, and 5. I will immediately remove my minor child/ward from participation, and notify the nearest official, if at any time I sense or observe any unusual hazard or unsafe condition or if I feel that my minor child/ward has experienced any deterioration in his/her physical, emotional or mental fitness for continued participation in the programme.
I UNDERSTAND AND AGREE, ON BEHALF OF MY MINOR CHILD/WARD, MYSELF, MY HEIRS, ASSIGNS, PERSONAL REPRESENTATIVES AND NEXT OF KIN, THAT MY EXECUTION OF THIS DOCUMENT CONSTITUTES:
1. an unqualified ASSUMPTION OF ALL RISKS associated with participation in this programme by my minor child/ward even if arising from negligence, or gross negligence, including any compounding or aggravation of injuries caused by negligent rescue operations or procedures, of the programme organizer and any persons associated therewith or participating therein, and
2. a FULL AND FINAL RELEASE AND WAIVER OF LIABILITY of the programme organizer and all persons and organizations associated with it and the programme including, without limiting the generality of the foregoing, its officers, directors, officials, agents and/or employees, other participants, sponsors, advertisers, owners and/ or lessors of the premises used to conduct the programme, sanctioning bodies, medical or rescue personnel (the RELEASEES), of and from with the respect to all injury, disability, death or loss or damage to person or property whether arising from the negligence, or negligent rescue of or by the foregoing or otherwise, and
3. an UNDERSTANDING NOT TO SUE the RELEASEES for any loss, injury, costs or damages of any form or type, howsoever caused or arising, and whether directly or indirectly from the participation of my minor child/ward in the programme, and
4. an AGREEMENT TO INDEMNIFY, and to SAVE and HOLD HARMLESS the RELEASEES, and each of them, from any litigation expense, legal fees, liability, damage, award or cost, of any form or type whatsoever, they may incur due to any claim made against them or any one of them whether the claim is based on the negligence or the gross negligence of the RELEASEES or otherwise.
I HAVE READ THIS DOCUMENT THOROUGHLY.
I UNDERSTAND THAT THE RELEASEES ARE RELYING UPON MY WARRANTIES, ASSUMPTIONS, WAIVER AND RELEASE, UNDERTAKINGS AND AGREEMENTS WHEN ACCEPTING MY MINOR CHILD'S/WARD'S PARTICIPATION IN THIS PROGRAMME.
I UNDERSTAND THAT BY CLICKING/CHECKING THE BOX BELOW I AM AGREEING TO THIS DOCUMENT & I GIVE UP SUBSTANTIAL LEGAL RIGHTS I AND/ OR MY MINOR CHILD/WARD WOULD OTHERWISE HAVE.

BILLING AUTHORIZATION
I represent and warrant that if I am purchasing something or paying for a service from this facility or from other merchants through this facility that (i) any credit card information I supply is true and complete, (ii) charges incurred by me will be honored by my credit card company or financial institution, and (iii) I will pay the charges incurred by me at the posted prices, including any applicable taxes, fees, and penalties.
I hereby authorize (if online payment is made or autopay information is provided) this facility to charge my credit card account. I understand that a 30 day written notice is required to terminate billing and I am responsible for payment whether or not my student attends classes until I notify this facility in writing to drop my student from class(es).
Should I dispute a charge through my financial institution this will constitute a breach of contract possibly resulting in, but not limited to, penalties, additional fees, collection, legal action, and/or termination of any and/or all current and future services.
MEDIA AUTHORIZATION
Sky Athletics will release photos and or videos to the media displaying the athletes of Sky Athletics during performance, events and/or classes. I understand that these photos and/or videos may include my child and I give consent accordingly. The media may include but is not limited to: print, web, and social media publicity.
RIGHT TO DECLINE OR DISCONTINUE SERVICES
Sky Athletics is a private business and reserves the right to cancel or decline services, registration at any time for reasons we see fit.
ZERO TOLERANCE
Sky Athletics is a children's facility that pride's itself in our family friendly positive atmosphere. The children of Sky Athletics are thriving on our supportive program, and we promise to protect this.
We have zero tolerance for any sort of drama, bullying or negativity - by athletes OR parents.
All Parents and Athletes in any program of Sky Athletics are expected to be emotionally and socially capable of conducting themselves appropriately with their peers/coaches and to actively participate. Parents and Athletes who don't demonstrate these abilities may be asked to withdraw from the program.
Your behavior on social media also represents Sky Athletics, posts about other members, staff, or Sky or our sport are ground for removal.
Due to our zero tolerance policy - we may not give warnings.
Committment
Full Year Athletes: June - April
Half Year Athletes: August - April
Tumbling Program: September - June
Twirly Tots, Twinkle Tots, Frozen: September - May
Refund Policy
Refund Policy Competitive Athletes:
There are NO REFUNDS, CREDITS, or RETURNS on registration fees, tuition fees, or Sky Wear items.
Absolutely no monies fundraised are refundable (via Sky Athletics or Shooting Stars).
If your family/student is removed from the program for negative behavior or attendance issues (in a class that requires attendance) no fees will be credited or refunded.
No refunds or credits are given for missed classes for any reason: this includes scheduling conflicts, injury, illness, homework, events, vacation, school
In the event that a class does not obtain enough athletes to run the class and it is canceled by Sky Athletics - fees will be refunded.
Payment Information
All classes/teams include monthly charges( plus tax) and a working credit card must be on file to be charged monthly or post dated cheques are required for payment. If you wish to pay up front in full you can pay: cash, etransfer, cheque or credit card.Payment/Billing
Non-payment of tuition means athletes cannot participate in practice. Our pay to play policy protects everyone's investment in Sky Athletics.
**NOTE** All of our members are provided a user name and password that allows them access into their "Family Portals" which permits you to register for any classes, see your account activity and change or modify your credit card information. Is it your responsibility to monitor your account and check this balance on a regular basis.
COMMUNICATION
Sky Athletics uses email as our primary source of communication. With this Sky Athletic portal account, you are providing consent for Sky to communicate with you via email on all matters related to your child's program and/or updates on upcoming events. You may unsubscribe from these emails at any time, however, this could result in potentially missing out on important information regarding your child's registration/program.

ARRIVAL PICK UP AND VIEWING
Be sure your student arrives 5 minutes before (no earlier please) his/her scheduled class time. Please pick up your athlete on time. For younger children, please instruct your child to wait inside the building and then escort them from the building to your car. During peak times the parking lot may be crowded. Please take into consideration that our athletes may include young children. Please drive slowly and carefully. Do not take a chance on your athlete running to and from your car.
Except for Little N Big Dipper classes, all of our Sky practices and classes are "closed". This means that only the students and the coaches are to be present. Spectators can be a distraction for students and we want to provide the best setting for optimum learning.
Sky prides itself on having the greatest staff and we want to build strong relationships with our athletes (they do need to trust us when we spot them and when we tell them they can do it unspotted!).
We highly recommend coming a few minutes (5) early for pick up as if your athlete gets a new skill or their team works on something new we bring ALL parents in the lobby to watch and celebrate!
PAY TO PLAY POLICY
Sky Athletics is is a privately owned business with paid staff. We acknowledge the importance of providing a safe environment and strive to have the best (from being clean to great equipment) facility for our athletes and family.
An investment in Sky Athletics is in an investment in your children - a concept we take very serious!
We promise to always collect funds from everyone to ensure we can continue to offer the best of the best as promised. and expected by our member.
To keep this promise our policy is: if you do not pay, you do not play. If you account is behind your child will be required to sit out of class/practice. If after the child 'sits' out no one contacts us or makes payment we will remove your family from the class/practice.
When your family makes a payment to our program, you do not choose how that payment is applied. Sky fees will always be taken care of before apparel, guest instructor fees, etc. No items will be given until balances are cleared.
We will send one email statement and communication is required immediately as to how/when your balance will be taken care of.
Early Team Termination
The Sky Athletics Competitive Program is an 11 month commitment: June - April
Half Year Teams: September - May
Someone quitting mid-season causes multiple problems for their team and Sky Athletics. When someone quits, instead of their team spending their limited practice time on improving, that time is spent re-choreographing the routines to "patch-up" the missing spots. It is a severe setback and hardship on everyone else on the team that has worked so hard and IS fulfilling their commitment to their team. It is unfair that the whole team must suffer because someone can't fulfill their commitment.
When an athlete terminates their contract earlier than this commitment, the gym assumes that the athlete is discontinuing permanently and they're required to pay a one month-transitional fee while we deactivate your file, fix routines and if necessary schedule extra practices.
Example: If Suzy's last practice/competition with Sky is on March 13th 2017 and she sends written notification to Sky informing that she will not be returning to practices for month 10 (April), she will be charged for the following month (April) If Suzy TELLS a Coach, the office is not notified properly and payments will continue. WRITTEN notice is the only accepted form of notice.
What to Wear
Athletes are required to dress comfortably and wear indoor athletic sneakers. You should bring a bottle of water (with your name on it!) No jeans or PJs. Fitted clothing is recommended. NO chewing gum or dangling jewelry. Hair should be pulled neatly and securely away from the face so that is stays up for the entire workout. Athletes are welcome to wear bows in their hair. PLEASE LEAVE JEWELRY ARTICLES AT HOME. Sky Athletics' staff will not be responsible for ANY items that may be lost, broken or stolen. Be sure your student's personal items are marked with their name. PLEASE BRING WATER. Also, NO CELL PHONES during class time please.
WEATHER CANCELLATION
For inclement weather, classes will be canceled within an 1 - 1.5 hour prior to the class. We do NOT base our closures on school closures. We do not base our closures on schools due to our operating hours and travel times differing from those of the schools. If classes are cancelled, you will be notified by EMAIL so please ensure that you have provided us an accurate email account. (Warning: if you unsubscribe from our e-mail notifications, you will not receive this email). We do not schedule makeup classes for inclement weather.
