Release of Liability
In consideration of being allowed to participate in any way in North Jersey Aquatics programs, its related events and activities, I, (name of participant) , the undersigned, acknowledge, appreciate, and agree that:
1. The risk of injury from the activities involved in this program is significant, including the potential for permanent paralysis and death, and while particular skills, equipment, and personal discipline may reduce this risk, the risk of serious injury does exist; and,
2. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation; and,
3. I willingly agree to comply with the stated and customary terms and conditions for participation. If, however, I observe any unusual significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the North Jersey Aquatics immediately; and,
4. I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE,
INDEMNIFY, AND HOLD HARMLESS North Jersey Aquatics, their officers, officials, agents and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and, if applicable, owners and lessors of premises used for the activity ("Releasees"), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law.
I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT , FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT
FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

This is to certify that I, as parent/guardian with legal responsibility for this participant, do consent and agree to his/her release as provided above of all the Releasees, and, for myself, my heirs, assigns, and next of kin, I release and agree to indemnify and hold harmless the Releasees from any and all liabilities incident to my minor child's involvement or participation in these programs as provided above, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES, to the fullest extent permitted by law.
Covid-19 Waiver and Procedures
Coronavirus, COVID-19 is an extremely contagious virus that spreads easily through person-to-person contact. Federal and state authorities recommend social distancing as a mean to prevent the spread of the virus. COVID-19 can lead to severe illness, personal injury, permanent disability, and death. North Jersey Aquatic Club in no way warrants that COVID-19 infection will not occur through participation in swim lessons or accessing NJAC facilities. I hereby certify on behalf of myself and the named minor that I have full knowledge of the nature and extent of the risks inherent in program participation and that I, on behalf of myself and the named minor, am voluntarily assuming said risks. NJAC will do its part to minimize exposure and risks associated with COVID-19.
With the global spread of COVID-19, we are trying our best to keep our community safe and we are asking you to read the following questions before EVERY swimming lesson:
• Have you been ill with fever, chills, cough, or body aches in the last 14 days?
• Has anyone in your household had these symptoms in the last 14 days?
• Have you or anyone in your household traveled internationally in the last 14 days?
• Have you or anyone in your household traveled to a location in the US where an increased incidence of COVID-19 has been reported in the last 14 days?
• Have you been told by a healthcare provider that you should self quarantine due to potential COVID-19 exposure or you are suspected of having COVID-19?
• Have you traveled out of New Jersey and to a state that is currently mandating a 14 day quarantine after returning?
IF YOU ANSWER "YES" TO ANY OF THESE QUESTIONS FOR YOURSELF OR YOUR CHILD, WE WOULD ASK YOU TO NOT ENTER OUR BUILDING AND WAIT TO RETURN UNTIL YOU CAN ANSWER ALL THESE QUESTIONS WITH "NO". SWIMMERS OR GUARDIANS WHO DISPLAY A TEMPERATURE OVER 100.4 WILL NOT BE ALLOWED TO ENTER OUR FACILITIES.
In many instances, the location we are renting will have its own requirements for entry. All requirements must be adhered to for entry. Our employees reserve the right to turn away anyone who is exhibiting symptoms or who they believe should not be allowed in to our facility. MASKS MUST BE WORN AT ALL TIMES (by all over age 2) WHILE IN OUR FACILIITES. NO EXCEPTIONS WILL BE MADE FOR ANY REASON, INCLUDING HEALTH REASONS. EMPLOYEES ARE REQUIRED TO WEAR MASKS WHILE ON THE POOL DECK (with the exception of the lifeguard, who is mandated not to wear one for safety reasons) AND ALL EMPLOYEES IN THE WATER ARE REQUIRED TO WEAR FACE SHIELDS AT ALL TIMES. ANY GUARDIANS WHO ENTERS THE WATER TO ASSIST THEIR CHILDREN WITH LESSONS ARE REQUIRED TO WEAR A MASK WHILE STANDING IN THE LESSON.
SPECIFIC ARRIVAL POLICIES FOR EACH LOCATION WILL BE SENT SEPARATELY TO THOSE REGISTERED AT THAT LOCATION AND MUST BE ADHERED TO AT ALL TIMES.

It is my intent as a participant or player competing in North Jersey Aquatic Club sanctioned
activities, while participating during activities including any pre-game or post-game
activities at all of our locations that I am agreeable to the following:
I acknowledge that I am aware that there are risks to me of exposure to directly
or indirectly arising out of, contributed to, by, or resulting from:
An outbreak of any and all communicable disease, including but not limited to,
the virus "severe acute respiratory syndrome coronavirus 2 (SARS-CoV-2)",
which is responsible for Coronavirus Disease (COVID-19) and/or any mutation or
variation thereof;
In consideration of having the opportunity to participate as either a team member or
competitor at location, and in acknowledging that I am aware of and willing to assume
the risks associated with this activity, I hereby voluntarily agree to waive, hold harmless
and indemnify North Jersey Aquatic Club and its trustees, agents, volunteers and employees
from any and all claims, demands, damages and causes of action of any nature
whatsoever arising out of ordinary negligence which I, my heirs, my assigns or
successors may have against them for, on account of, or by reason of my participation in
the above activities. I indicate my agreement to this hold harmless elective noted below.
Scheduling Procedure
In order to request a class, please fill out this form in its' entirety and submit. Class choice will be determined by timestamp starting on the first day of registration. You then will receive a class confirmation e-mail. This will include your final total to be charged to your card. If a yearly registration fee is due, it will be added after you register and will not be reflected in your initial totals. If for some reason the class choice you have chosen is not the correct space for your child, we will email you to switch to a different class.
If none of your class choices are available, we will contact you to choose another time. If no open spaces are available, a wait list will be established and swimmers will be accepted as space becomes available.
NJAC reserves the right to schedule classes in a manner such that the levels of each class are as balanced as possible. We make every attempt to put all siblings together in the same time slot and to match swimmers with similar abilities. We reserve the right to cancel or consolidate any classes with less than 3 swimmers. In this instance, a swimmer would be offered other available class options, but no refund will be given.
Equipment Backpack $25
Backpack Program
Each swimmer is going to be getting their own NJAC Equipment Backpack with level-appropriate equipment. This will be something that you will purchase in your first session with us post 9/1/2020, and will not need to purchase every session. This backpack will be required for participation at every lesson, so please be sure to bring it every week, just like you need a swimsuit to participate.
What if my child moves up a level?
When your child moves up from a 1a/1b to a level 2 and beyond, they can trade in their old equipment for more advanced sinker toys, etc.
What if I forget my bag?
Unfortunately, due to these rules, there will be no equipment to borrow if you forget yours. A swimmer who is level 1b and below can still participate in the lesson but will have a parent on the side sitting with them for safety reasons. In pools where there is limited capacity, students without their backpacks will not be able to participate in the lesson that day, and will not be provided a makeup due to the mixing of cohorts. We realize this is not ideal, but the safety of our students and families is our highest priority and we have designed these policies to protect our families.
How do I purchase a bag?
For this first session, the $25 backpack fee will be automatically added to your account and charged to your card on file before your first lesson. We will be assessing children on the first day and recording their current levels and giving them backpacks according to ability. The bag they will purchase is as follows:

Some level 2 swimmers will receive the beginner backpack and some will receive the advanced backpack. We will determine after the first day which is best for your swimmer based on ability.

Rolling Quarterly Registration Policy -TEMPORARILY SUSPENDED
AUTOMATIC ENROLLMENT HAS BEEN SUSPENDED AS OF 9/1/2020 - THE POLICIES BELOW WILL BE REINSTATED AT A FUTURE DATE, BUT AS OF THIS DATE THERE ARE NO AUTOMATIC ENROLLMENTS. EVERY SWIMMER WILL HAVE THE OPPORTUNITY TO REENROLL IN THEIR CURRENT SPACE BEFORE REGISTRATION IS OPEN TO THE PUBLIC. WE WILL REQUIRE A RESPONSE FROM EVERY SWIMMER NOTIFYING US IF THEY WANT TO CONTINUE TO THE NEXT SESSION OR DROP THEIR CURRENT CLASS AND NOT CONTINUE.
The Rolling Quarterly Registraton POLICY BELOW IS SUSPENDED UNTIL FURTHER NOTICE:
Beginning August 1, 2018, our program will follow an AUTOMATIC ENROLLMENT policy. Here are the details of this program:
1. Swimmers will consistently swim session after session in the same time slot by being automatically enrolled in the next session.
2. Swimmers who have been promoted by an instructor can move to a more advanced class mid-session by simply requesting a class transfer at any time.
3. Swimmers who want to stay in the same class will continue to be challenged as their curriculum will be customized to meet their increasing skills.
4. Swimmers have the option to switch days, times and teachers at any point by contacting the office and asking for a change.
5. Parents will no longer need to re-register, as students will be automatically enrolled in to registration for the next session.
6. Parents will have an easy way to opt out of enrolling in the next session by simply sending an email to disenrollment@northjerseyaquatics.com to request disenrollment. If this email is not received by the scheduled date for that specific session, the credit card on file will be charged for the next session. (See dates below)
7. Parents can opt out immediately upon registration, or any time up until our final day of disenrollment.
8. It is the responsibility of the parent to keep a valid credit card on file.
THERE IS NO AUTO ENROLLMENT FROM SUMMER INTO FALL. ALL SWIMMERS WILL RE-REGISTER FOR FALL 2020.
Payment Policy
TYPICALLY A SESSION OF LESS THAN 9 WEEKS IS REQUIRED TO BE PAID IN FULL UPON REGISTRATION. FOR WINTER 2021 ONLY, we will be offering the opportunity to pay in TWO installments, which will be due on December 1, 2020 and December 30th, 2020. All registrations must be paid in full prior to your first day in the pool. If you choose the 2 installment option, an additional $10 fee will be added to each installment.
A credit card is required for all registrations. If you choose to pay in cash, you must still enter a credit card in order to hold your space, and then can make special arrangements through email with admin@northjerseyaquatics.com to drop off a cash payment to our office. Cash payments must be made within 48 hours of registration, or the card on file will be charged automatically.
There will be a registration fee of $50 for one swimmer or $80 per family applied once per calendar year when your family registers for its first class of the year. This fee is paid once per year for every calendar year that a family registers in our program.
Programs due in full include but are not limited to mini sessions, promo sessions, lifeguard classes, and competitive program bookings. There will be a $10 fee per installment added to your charges if you choose this installment plan. Once a session has began, payment is due in full upon time of registration.
A $30 fee will be charged for any declined payments. Please be sure your account on file has been updated PRIOR to the date you are scheduled to be charged.
Make-Up Policy
AS OF 9/1/2020, THERE WILL BE NO MAKEUP LESSONS SCHEDULED FOR ANY REASON. THIS POLICY WILL BE ENFORCED UNDER ALL CIRCUMSTANCES AND THERE WILL BE NO EXCEPTIONS DUE TO US WORKING TO KEEP SWIMMERS TOGETHER IN THEIR OWN DAY/TIME/LOCATION COHORTS. BY SIGNING THIS POLICY, YOU ARE AGREEING THAT THERE WILL BE NO MAKEUP LESSONS FOR ANY REASON DURING THIS SESSION.
North Jersey Aquatics Club strongly believes that students learn best in a stable consistent environment. We also understand that illness and injuries are part of life, but due to the state of the world currently, we are not allowed to make any exceptions to our makeup policy. In order to keep the consistency and structure needed for the children we can not schedule a make up for any other time or day, regardless of the reason you are missing class.
As a courtesy, we request that you inform NJAC of your child's absence by filling out our Report an Absence form on our website or in our app. This can be done any time BEFORE your child's class actually starts.
In the event of severe weather or pool malfunction, we will offer you a makeup class free of charge. We cannot guarantee instructors for makeup classes. If you can not make the scheduled make up class, unfortunately we are not allowed to make it up at any other time due to keeping cohorts together.
Finally, in instances of extreme illness or family conflict, we attempt to work with each family individually to determine if lessons can be made up in a future session. Rescheduling of lessons will only be considered if NJAC is informed of the absences prior to the date missed.
Refund Policy
North Jersey Aquatic Club will not refund money for any services that have been scheduled. We will give 80% credit toward your account to be good for one year from the date of payment if the cancellations follow our cancellation policy. If a session is delayed or cancelled due to a widespread pandemic or natural disaster, the session will resume when it is possible to do so, or a credit will be placed on each family account to be used for a future session. No refunds will be given.
Cancellation Policy
All cancellations must be in writing via email. Cancellations are eligible for 80% credit of your remaining classes, regardless of whether a session has begun or whether this is for a future session you paid for. Credit will be valid for one year from the date of original payment and put into effect from the day of your cancellation in writing. Account credit can be used for any family member. Notice to cancel must be given 48 hours prior to your next scheduled class in order for that class to not be counted. No refunds will be given for any reason. If a pool closes for any reason including contamination, maintenance, or any other circumstance, makeups will be provided at one of our locations, but we cannot guarantee what days/times/locations will be available. Registration fees are non refundable, non transferrable, and not able to be used for a future year.
Transfer Policy
As of 9/1/2020, our transfer policy has changed. Transfers will be accepted up until 7 days before our session begins. After that date, no more transfers will be honored until the next session is announced. You must complete your session in the class you originally chose, and then can choose a new day/time/location for the next future session. This is put in place to keep our day/time/location cohorts consistent.
Publicity Release
Acting on behalf of my child, I hereby release for public display, my child's image to be utilized for the purpose of marketing and advertisement by North Jersey Aquatic Club, LLC. I understand that my child's image may be used on NorthJerseyAquatics.com and I waive my right to collect payment or royalties for the use of photos taken while enrolled in North Jersey Aquatic Club, LLC programs.
Off Site Policies
Off Site Polices Differ from our Normal On Site Locations
1. All Off Site lessons will be held rain or shine, except for in dangerous weather situations. Cancellations will be determined by your instructor and communicated to each family directly. Decisions will not be made via the NJAC office or main phone number. Please make sure to exchange phone numbers with your instructor the first day of class.
2. Swimmers will receive a makeup for one cancellation for each package of 8 lessons booked. We will make every effort to provide your make up at your offsite location with your regular teacher. However, this will be contingent on openings in your instructor's schedule. If a make up time can not be agreed on, a make up will be provided at one of our locations with a different teacher. All make ups must be completed by the end of the session. No credits or make ups will be provided after this date.
3. When registering for our offsite program, a $45 nonrefundable deposit per family will be charged to your card on file as soon as you register. Your Family Registration Fee will also be charged on this date. This deposit will be applied to any tuition fees once your class days/times have been established. All offsite lessons must be completed by August 15th in the year booked.
Clinic and Intersquad Swim Meet Program
AS OF 9/1/2020, our clinic program has changed. Due to keeping our day/time/location cohorts the same, there will be no swapping or making up in different clinics. You must attend the day/time you have registered for. No makeups are available in any other classes.
Equipment Policies
As of 9/1/2020, all swimmers will be required to bring his/her own equipment back and forth to lessons. No sharing of equipment will be allowed and swimmers must have all gear at every lesson in order to participate. Equipment includes all back floats, rubber ducks, kickboards and and sinking toys. When registering, all students in Levels 1a, 1b, 2, 3, and 4 and clinics will be assessed a $25 equipment fee. At their first class, swimmers will be issued an NJAC backpack with level appropriate equipment inside. This purchase is required for participation in these levels.
