Assumption of Risk
Please read carefully before signing. This is a release of liability and waiver of certain legal rights.
I, the undersigned, the parent/guardian of the participant and /or the participant agree and understand that swimming and other Rec Center activities are HAZARDOUS. I recognize that there are risks inherent in these activities, which include, but are not limited to, paralyzing injury and death.
Release of Liability
The parent/guardian of the participant and/or the participant hereby agrees to hold harmless the OHHA, its teachers, directors, officers, agents and employees against any liability resulting from any injury that may occur, and also to indemnify the OHHA for any damages incurred arising from any claims, demand, action or cause of action relating to the participant.
Medical Emergencies
The parent/guardian of the participant and/or the participant authorizes any representative of the OHHA to have the participant treated in any medical emergency during their participation in the OHHA programs and also agrees to pay all costs associated with medical care and transportation of the participant. I have read the above Liability Release and signed it with full knowledge of its content and significance.
Rules and Policies
Additionally, I, the undersigned, the parent/guardian of the participant and/or the participant agree to abide by all rules and policies as posted, communicated by staff or the OHHA Board and to communicate these rules and policies to the participants named below and our guests. On their behalf, I agree all will abide by said rules and policies, inclusive of the OHHA zero tolerance policy regarding harassment. Any resident or guest not abiding by said rules will be subject to discipline that may result in the loss of privilege to use the Oak Hills Rec Center facilities and/or participate in recreation programs.
Supervision
All children under the age of seven must be accompanied by an adult. Adult accompaniment is recommended for children ages 7-14 years. OHHA assumes no responsibility, oversight or guidance concerning any unaccompanied minor. OHHA reserves the right to require adult supervision for any minor as deemed necessary by staff or directors.
When the pool is open with no guard on duty (posted times), adults must accompany all children under the age of 18. Adults are responsible for oversight and safety of minors at all times and adhere to posted pool rules. There will be times guards are present and times when they are not; by signing this agreement, I understand I am responsible for minors in the pool area at all times.
Facility Usage
I understand the facilities of the OHHA, including recreation area (pool, community room, tennis courts, gym), green space and common space are for homeowners and their perspective guests' usage. I am responsible for the actions and behaviors of my guests when in these areas. If damage occurs on the property, I understand I am responsible to pay for repairs.
COVID WAIVER
The novel coronavirus, COVID-19 is extremely contagious, and has been declared a worldwide pandemic by the World Health Organization. Oak Hills HOA has put in place preventative measures to reduce the spread of COVID-19, however Oak Hills HOA cannot guarantee that you, your child(ren) or group will not become infected with COVID-19. Furthermore, attending Oak Hills HOA could increase your risk and your group or child(ren)'s risk of contracting COVID-19.
By signing this agreement, you acknowledge the contagious nature of COVID-19, and voluntarily assume the risk to your participants and family members, and staff, and others who may be exposed to, or infected by COVID-19 by attending and using the facilities at Oak Hills HOA, and that such exposure or infection may result in personal injury, illness, permanent disability, and death. You understand that the risk of becoming exposed to or infected by COVID-19 at Oak Hills HOA may result from the actions, omissions, or negligence of the Oak Hills HOA employees, volunteers, program participants/athletes, and their families.
You voluntarily agree to assume all of the foregoing risks, and accept sole responsibility for any injury to participants and staff, (including but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense of any kind that may be experienced or incurred in connection with your use. On your behalf, and on behalf of the participants, you hereby release, covenant not to sue, discharge, and hold harmless, Oak Hills HOA, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of and related thereto. You understand and agree that this release includes any claims based on the actions, omissions, or negligence of Oak Hills HOA, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any Oak Hills HOA program.
If at any time if you are not following Washington County Guidelines, your agreement is subject to immediate termination.
