payment/cancellation policy
Payment for all lessons or services are due on the first of each month prior to the beginning of the start date. IF the 1st of the month is a holiday the payment will be charged to the card on file on the business date prior to the holiday. A statement will be emailed to each client on the 20th of the Month prior to the start date so the client knows the amount being charged to the card on file. All clients are required to keep a valid working card on file for swim lesson fees to be charged to. The client may choose to pay in cash or check PRIOR to the charge date. The payment MUST be received by Wisconsin Swim Academy within 2 days of the charge date in order for Wisconsin Swim Academy to post the payment and change the payment type.
Any checks that have been returned for Non Sufficient Fund reasons or any other reason will be subject to a $35.00 late fee.
Cancellation of any lessons MUST be done 30 business days PRIOR to the swim lesson start date. Any cancellation after this date will still be responsible for the entire amount owed of that month. Any persons not paying this amount owed will be subject to collections as well as late fees. If the credit card on file is declined for any reason the student will be removed from the class unless the payment is resolved within 24 hours.
General LIabilities
I expressly warrant and represent that I am the parent, adult student or legal guardian of the Swimmer Participant on whose behalf I am completing this registration, and have full legal authority to agree to the terms contained in this Waiver and Release of Liability. In this document, the Swimmer Participant on whose behalf I am completing this registration is referred to as "my child". In sending my child to swimming lessons at the facilities operated by Wisconsin Swim Academy LLC, I understand that I am giving my child permission to participate in all swimming instructional and recreational activities.
Personal Property
I understand that any items I or my child bring to lessons (camera, personal electronics, etc.) are the responsibility of myself or my child, in no way is Wisconsin Swim Academy LLC responsible for lost items.
Assumption of Risk
I acknowledge and fully understand that myself or my child will be engaging in activities at Wisconsin Swim Academy LLC, that involve risk of injury. These activities include (a) swimming and other in-pool activities that involve the risk of tripping, falling, slipping, drowning and similar risks that could result in serious injury and/or death. There may be other risks not known to us or not reasonably foreseeable at this time. I assume all the foregoing risks, accept personal responsibility for any damages incurred by my child following such injury, permanent disability or death, and agree to indemnify and hold Wisconsin Swim Academy LLC and its affiliates and partners in the operation of the Swim School or hotel harmless from and against all claims, costs, expenses and liabilities, including attorney fees, for injury to person or property arising in connection with my child's participation in any activities, the Wisconsin Swim Academy LLC lesson program and use of facilities and equipment owned by Wisconsin Swim Academy LLC and/or its affiliates or partners.
Waiver of Rights and Release of Liability
I, on behalf of myself, my child, and my child's parents and/or legal guardians hereby release, waive and discharge, Wisconsin Swim Academy LLC and their employees and agents from all losses, damages, claims, costs, expenses and liabilities, including attorney fees, for injury to person or property arising in connection with my child's participation in swimming activities and use of the facilities and equipment owned by Wisconsin Swim Academy, LLC, and/or their affiliates and partners, providing, however, that this waiver and release does not include injury, damage, or loss as a result of the intentional or reckless acts of Wisconsin Swim Academy LLC and/or their partners and affiliates, and each of their agents and employees.
Limitations of Damages
I agree that my sole remedy, and the sole remedy of my child, his parents and legal guardians is a refund of the enrollment fee paid to Wisconsin Swim Academy LLC. for the lesson program session in which any injury, death or property damages occur. In no event shall the liability of Wisconsin Swim Academy LLC, or any of their affiliates or partners, if any, to my child, the parent or legal guardians of my child, or any third party, whether in contract, tort (including negligence), or otherwise, exceed the enrollment fee (or portion thereof) actually paid to, Wisconsin Swim Academy LLC, for the lesson program session during which such loss or damage occurs.
Waiver of Rights to Bargain
I have considered that if this Waiver and Release of Liability was not as broad as it is, the enrollment fee for Wisconsin Swim Academy LLC, lesson program might be considerably higher. Since I do not wish to pay a higher enrollment fee, I waive the right to bargain for different terms under this Agreement. I expressly understand that in lieu of agreeing to the terms contained in this Agreement, I may contact the Manager Wisconsin Swim Academy LLC, and attempt to bargain for terms different from those contained in this Agreement. By clicking the "accept" button, I understand that I am waiving my right to bargain and accepting the terms contained herein. I acknowledge that, in the absence of a written agreement signed by a Manager of Wisconsin Swim Academy LLC that my child's participation in Wisconsin Swim Academy LLC, lesson program shall constitute my acceptance of the terms contained in this Agreement
Severability
If any portion of this Agreement is held invalid, it is agreed that the balance shall continue in full legal force and effect.
I acknowledge that I have carefully read the above Waiver and Release of Liability, understand its contents, and I recognize that by signing this legally binding Agreement on behalf of myself and my child and other parents and guardians of my child, we are freely giving up substantial rights and assuming all risk of injury, death and property damage.
Make up lessons/pool rules
Students enrolled in swim lessons will be allowed one make-up lesson per month. The only exception to the one make-up policy is if Wisconsin Swim Academy LLC has to cancel lessons due to a weather emergency or a pool incident. Under these circumstances, space permitting, we will allow an extra make-up lesson. Due to our low instructor to student ratio, we cannot guarantee the availability of make-up classes. If you are unable to find a time that works for your schedule, we can offer make-up times at our other locations.
All make-up lessons must be done within 30 days of the lesson that was missed. It is solely the responsibility of the CLIENT to contact Wisconsin Swim Academy to schedule the make up lesson. We do not carry over missed classes. Cancellations of other types will be handled on a situational basis. Make-up lessons can NOT be rescheduled due to the limited space. If your student is paying for a semi-private lesson and there is not another student registered in the class, thus making this a private lesson at a semi-private rate, your student will not get a make up lesson due to the fact that they are getting an extra 15 minutes each class. Wisconsin Swim Academy reserves the right to schedule a make up lesson in this spot. Wisconsin Swim Academy reserves the right to make exceptions to this policy. If you do not let us know that your swimmer will be absent, they WILL NOT get a make up lesson. No refunds are given in regards to missed lessons. If a missed lesson can not be made up we will credit your account to be used at a future semester unless more then one lesson is missed during the month. The AmericInn Hotel does not allow Wisconsin Swim Academy guests to swim prior or after their scheduled swim lessons unless they have purchased a swim pass from the Hotel front desk and are swimming during the open swim times allocated by the hotel. Open swim times are subject to change at the management's discretion.
Swim Diaper Policy
Swim Diapers: Wisconsin Swim Academy requires all swimmers who are recently toilet trained and those who are not toilet trained to wear a well-fitting, swim diaper. Swim diapers must fit snugly in order to contain a bowel movement, so please do not purchase one for the child to "grow into". Fecal accidents are costly to Wisconsin Swim Academy LLC and an inconvenience to families since they may cause us to shut down the pool. We recommend a reusable diaper. The backs of disposable swim diapers are not tight enough to hold in solids, and the lining inside them can disintegrate which clogs the pool filters. Reusable swim diapers are available for purchase through Wisconsin Swim Academy and other retailers.
Bathroom Incidents: Please make sure that your children use the bathroom before each lesson. If they are feeling sick or have a stomach ache, we ask that you do not bring them to class. Bathroom accidents are very costly to Wisconsin Swim Academy LLC and are an inconvenience to families since they may cause us to shut down the pool. Thank you for helping to keep our pool clean.
