COVID Waiver and Acknowledgement
An inherent risk of exposure to COVID-19 exists in any public place where people are present. COVID-19 is an extremely contagious disease that can lead to severe illness and death. By visiting Splash Swim School, you voluntarily assume all risks related to exposure to COVID-19.
I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my family, including child(ren), and I may be exposed to or infected by COVID-19 while on site at the pool and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at the pool may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Splash Pool Services, Inc. and the company's employees, volunteers, and program participants and their families. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I, my family and my child(ren) may experience or incur in connection with my child(ren)'s attendance at the pool or participation in pool activities ("Claims"). On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless Splash Pool Services, Inc. and the company's employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of Splash Pool Services, Inc. and the company's
employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in pool facility activities.
ASSUMPTION OF RISK
I understand and agree that there are inherent risks associated with activities offered at and by Splash Swim School. Such activities include, but are not limited to group and private swimming lessons, "dive-in" movies, birthday parties, lifeguard training classes, CPR/1st Aid classes, and other uses of the facility. Despite such risks, I, my child, my ward, any person under my direct supervision, am/are voluntarily choosing to participate in such activities. As such I assume, on behalf of myself, my child, my ward or any person under my direct supervision, all risk of personal injury, disability, death, or property damage associated with whichever activity I/we am/are registered for at Splash Swim School. I acknowledge that I, my child, my ward, any person under my direct supervision, have no known medical, physical or emotional health problems that prevent them from participating in such activities.
RELEASE OF LIABILITY
As a voluntary participant, legal parent, or guardian of participants I release Splash Pool Swim School and Pool Services, Inc., its owners, shareholders, employees, partners, volunteers, manufacturers, affiliates from any and all future liability, claims, demands, and/or causes of action that may arise from participation in any and all activities at Splash Pool Swim School. Further, I hereby release, hold harmless and indemnify, including attorney or court fees and costs, and discharge Splash Pool Swim School and Pool Services, Inc., as well as the aforementioned released parties, on behalf of myself and all of my family members (current and future), agents or personal representatives. This release is valid and effective whether the damage, loss, or death is a result of any act, or omission on the part of any Released Parties or from any other cause. This Waiver and Release includes, without limitation, injuries, or accidents, which may occur as a result of use or misuse of the facility in any way, by anyone, use of any equipment that malfunctions or breaks, improper maintenance of the facility, grounds or any equipment, instruction or supervision, or slipping, tripping and/or falling while at the facility or on the premises (including the parking lot and grounds).
TERMS AND CONDITIONS
Cancellations: Our perpetual lesson model allows you to continue with classes without renewing each month. In the event that you choose to withdraw from classes you must submit a withdrawal notice 30 days prior to the final lesson. Should you withdraw without 30 days notice you will be charged for your final month. Withdraw notices are located at the front desk. Should you need to cancel one lesson; i.e. a private lesson, please provide us with 24 hours notice.
Refunds: Due to operational costs refunds are not offered.
Purchase Policy: You must register 48hrs. prior to your first class. There is a one time registration fee of $25 per swimmer, not to exceed $50 per family.
NSF Fees: $35 will be charged for all returned checks and credit card rejections.
Class Consolidation: We reserve the right to consolidate/combine group lesson classes with less than 3 swimmers enrolled. You will be called in advance of the class with notification.
Make-Up Classes: Make-up classes will only be offered for classes cancelled by Splash Swim School; for such things as emergencies, weather, fecal contamination, etc.
Scheduling: Classes are ongoing. Students will be enrolled in the same time slot until they graduate out of that level at which time you will be contacted to choose another time slot to enroll them in the next level. We will do our best to accommodate instructor request, however this is not guaranteed.
Double Diapering: Non-toilet trained swimmers, and all swimmers under the age of 3 must be double diapered. This means a disposable swim diaper underneath a reusable swim diaper. Fecal contamination MAY cause closure of the facility for 24 hrs.
Release of Photographs: I hereby grant Splash Swim School and Pool Services, Inc. the right to photograph, videotape, and/or record, use the likeness, face, voice and appearance in connection with publicity, advertising or promotional materials without reservation, limitation or compensation me and/or my child, ward, any person under my direct supervision.
Miscellaneous: Please have your child visit the restroom prior to class.
Please arrive at our facility at least 10 minutes prior to class start time. Changing areas are available, but space is limited so please have your swimmer dressed in their bathing suit upon arrival. Showers available in the changing areas, but again space is very limited. If your child would like to rinse off after class, please make sure they are in the shower no longer than three minutes.
Viewing area: Due to our limited deck space we ask that you view your child's classes from our viewing area. Children must be monitored while in the viewing area. An adult guardian will always be on the premises during activities. Failure of an adult guardian will result in forfeiture of the lesson/activity.
