RELEASE AND WAIVER OF LIABILITY
RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT!
In consideration of participating in the XTREME CHEER AND GYMNASTICS ALL-STAR CHEER AND/OR TUMBLING PROGRAMS OR OPEN GYMS/BIRTHDAY PARTY/PARENT TEAM. I represent that I understand the nature of this activity and that I/my child am/is qualified, in good health, and proper physical condition to participate in such activity. I fully understand that this activity involves risks of serious bodily injury including permanent disability, paralysis or death,which may be caused by me/my child's own actions or inactions, those of others participating in the event, the conditions in which the event takes place, or the negligence of the "releases" names below, and that there may be other risks either not known to me or not readily foreseeable at this time. I fully accept and assume all such risks and all responsibilities for losses, costs and damages I incur as a result of my participation in this activity.
I herby release, discharge and covenant not to sue XTREME CHEER AND GYMNASTICS #1 INC, it's respective administrators, directors, agents, officers, volunteers, and employees, other participants, and sponsors if applicable, owners and lessors on which the activity takes place (each considered one of the "releasees" herein) from all liability, claims, demands, losses damages, on my account caused or alleged to be caused in whole or in part by the negligence of the releases or otherwise including negligent rescue operation and further agree that if, despite this release, waiver of liability, and assumption of risk, I or anyone on my behalf, makes a claim against any of the releases, I will indemnify save and hold harmless each of the releases from any loss, liability, damage, or cost, which may result of such claim.
I have read the Release And Waiver of Liability, Assumption of Risk, and Indemnity Agreement, and understand that I have given up substantial rights by signing it and signed it freely and without any inducement or assurance of any nature and intend it to be a complete and unconditional release of all liability to the greatest extent allowed by law and agree that if any portion of this agreement is held to be
invalid the balance, notwithstanding, shall continue in full force and effect.
UPDATED POLICIES
Xtreme Cheer and Gymnastic Policies ***PLEASE SEE CHANGES TO THE POLICIES***
1. Please arrive a few minutes early for your class.
2. Wear comfortable clothes, no zippers or metal snaps or buttons, take out all jewelry. No acrylic/fake nails or jewelry can be worn during class as it is a safety hazard. Tennis shoes should be worn for cheer class. Socks or barefoot is fine for tumbling classes.
3. Please send your child a water bottle, with thier name of it for each class. DRINKING FOUNTAIN IS CLOSED AT THE CURRENT TIME, but bottles may be filled up in the sink. Water bottles are available for purchase most evenings for $1 at the front desk.
NEW PROCEDURES PER COVID GUIDELINES:
1. Parents may drop off the athlete at the top front door. If parent is entering the building, masks must be worn at all times. In order to abide by spacing limitations, we have to ask you to stay outside to wait for your child's class to end. For any first time athletes or trial classes, we will schedule times for their parents to watch their class until comfortable with enrollment.
2. Knock- (or wait behind a marked area) Staff member will open doors for you and will do a distanced temperature check while greeting your child.
3. Athlete will sanitize hands and shoes before entering the main gym area.
4. Place bag and water bottle in waiting area on a hook. Hooks and chairs will be distanced 6 feet apart. There are cubbies and hooks for bags, jackets, or water bottles. Please send as little as possible.
5. Athletes will be required to wear masks while in the waiting areas or while stretching but not during physical exercise or lessons.
6. Before each class, athlete will wash hands in sink.
7. Our floors are sealed with an antimicrobial protective layer. All mats and equipment will be sanitized between classes and at the end of each night.
9. Class settings are kept to a 1 to 10 ratio to provide smaller class settings.
10. When finished with your class or lesson, return to the waiting area, put on mask, and remove shoes. Put all items in your bag.
11. Exit through back doors and staff member will give you hand sanitizer and make sure you get to your car/parent.
12. Parents should form a pick up line by the bottom of the stairs. Staff will make sure athletes get to their cars safely.
13. There is to be no other food or drinks brought into the gym at this time, your child may bring their own water bottle and place in a cubby or their own bag.
14. There will be no visitors at this time to classes.
15. If your child is young we will soon be setting up classes where 1 parent may attend with the child. The parent must wear a mask at all times and follow all protocols listed.
16. Please make sure that your child collects all belongings, anything left over a week will be thrown away or donated.
17. If we are closed due to weather we will send an EMAIL and a TEXT, as well as post on our Band page and social media. You MUST sign up through the portal with a mobile number and check "opt-in" If you do not do this we will do it for you. This is the fastest way to let you know that we are closed for weather.

18. If you are absent from a class, you may make it up within 2 weeks, you will need to check with the front desk or email us to schedule your make up class. *** you may now schedule absences and makeups on the parent portal. DO NOT SHOW UP FOR A CLASS WITHOUT SCHEDULING IT FIRST.

The coaches are dedicated to teaching the kids and do not handle individual accounts.

MEDICAL EMERGENCY
Medical Emergency
The undersigned gives permission for the Xtreme Cheer and Gymnastics #1 Inc owners, officers, employees, and/or agents whether paid or volunteer to seek and give appropriate emergency medical attention for the participant(s) during class, practice or competition, including to or from a competition in the event of accident, injury, or illness in the event they are unable to reach any parent or guardian. I understand that I will be responsible for any and all costs of medical attention and treatment. I represent that the participant is covered by medical insurance. I understand that cheerleading, tumbling, and gymnastics are inherently dangerous and that injuries occur. I represent that I have sought the opinion of the participants physician and that participant is physically fit and mentally capable of participating on a cheer team, gymnastics team, and/or recreational class.
Financial Responsibility for Classes
Financial Responsibility & Payment Information
There is a registration fee of $36 one time, per year, per family. This will be charged to the account on file on upon enrolling in a class(es). The registration fee is non-refundable and will be charged each year on the anniversary of the month you began classes, as long as you are enrolled in classes. Cheer teams will have the registration fee added in the yearly fees, each year.
Tuition is charged on the 1st of each month and is based on flat monthly rates.
Tuition will be automatically deducted from the card on file on the 1st of every month.
All customers are required to have a credit card or debit card or bank account on file with Xtreme Cheer And Gymnastics for automatic, recurring monthly payments.
I understand that the credit card listed on this registration form will be charged at the time of registration. All declined cards will be re-ran each day until funds are available.
If you choose to pay by cash/check, it must be received and posted by our business office BEFORE THE 1st of the month . There is a $10 late fee added to the account after the 7th of the month. There may be a $30 charge for any checks returned or declined payments by the bank.
Failure to pay by the 2nd class of the month will result in removal of your child from class.
THERE IS A 30DAY NOTICE REQUIRED TO DROP ANY CLASS. CHEER CONTRACTS HAVE DIFFERENT AGREEMENTS.
Upon enrollment, your credit card will be added to our convenient automatic payment program. Your card will be charged on the 1st of each month. All customers will be automatically enrolled into the next monthly session and charged the monthly fee unless you:
1. Notify our business office by the last day of the preceding month (i.e. You wish to drop your child from the class for May, you must notify by March 31st)
2. Notification must be emailed to XCACHEERKC@GMAIL.COM or stopping by the front desk and letting Robin know.
If any payments are made with a check, and is returned, checks will be sent directly to Global Check Recovery for collections, these checks will be subject to electronic redeposit without further notice. You will also incur a late fee on your account.
I understand that I am financially responsible for payment of all fees at Xtreme Cheer And Gymnastics for the above athlete including but not limited to tuition, competition fees, registration, uniforms, shoes, choreography, and practice wear.
Exposure
An inherent risk of exposure to COVID-19 exists in any public place where people are present. COVID-19 is an extremely contagious disease that can lead to severe illness and death. By attending any classes or events at Xtreme Cheer And Gymnastics #1 INC, you assume all risk related to exposure to COVID-19 to you and your family.
