Assumption of Risk
I understand that participating, or allowing my child(ren) to participate, in any and all programs, events, classes, camps, and activities ("Programs") offered by Motion the Dance Studio, LLC and its owners, officers, shareholders, members, managers, agents, employees, instructors, and affiliates (the "Released Parties") and using, or allowing my child(ren) to use, any equipment provided by the Released Parties in connection with the Programs ("Equipment") involves risk, danger, or hazards that may cause serious personal injury or death and that injuries are a common and ordinary occurrence from participating in the Released Parties' Programs or using the Released Parties' Equipment. As the parent or guardian of the child(ren) listed below, I hereby give consent for my child(ren) to fully participate in the Programs offered and to use the Equipment provided by the Released Parties. I fully accept and assume all risk and responsibility as a result of my or my child(ren)'s participation in Programs offered and use of the Equipment provided by the Released Parties. I voluntarily elect to participate, or to allow my child(ren) to participate, in the Programs offered and to use, or allow my child(ren) to use, the Equipment provided by the Released Parties. I fully understand the health and safety risks associated with the types of Programs offered and the types of Equipment provided by the Released Parties. I understand that the Programs offered and the Equipment provided by the Released Parties are inherently dangerous and that my or my child(ren)'s participation and use may cause harm or grievous injuries, including bodily injury, damage to personal property, and/or death. I hereby confirm that I and my child(ren) is/are in good physical condition and do not suffer from any disabilities or physical conditions that place me or my child(ren) or others at risk. I, therefore, assume all risk of injury and/or death associated with my or my child(ren)'s participation in the Programs offered and use of the Equipment provided by the Released Parties. I will not hold the Released Parties liable for any circumstances of or arising from my or my child(ren)'s participation in the Programs offered and use of the Equipment provided by the Released Parties.
I hereby, on behalf of myself and my child(ren), release, waive, discharge and covenant not to sue or bring any action against the Released Parties from any and all liability, claims, demands or causes of actions whatsoever for personal injury, harm, loss, damage and/or damage to personal property and/or death that may occur while I or my child(ren) participate in the Programs offered and use the Equipment provided by the Released Parties or while I or my child(ren) are on any premises where the Released Parties are offering any Program or providing any Equipment (regardless of whether the premises or Equipment are owned, leased, rented, or managed by the Released parties) and which are caused by the breach of any express or implied warranty or the negligent act or omission of any Released Party, including in the design, location, construction, inspection, maintenance, operation, and/or repair of the Programs or Equipment. I further agree that if, despite this release I, my child(ren) or anyone on behalf of myself or my child(ren) makes a claim against any or all of the Released Parties, I will indemnify and hold harmless each of the Released Parties from any litigation expenses, attorney fees, loss, liability, damage or cost any Released Party may incur as the result of any such claim.
In the event of an accident or emergency during my or my child(ren)'s participation in the Programs or use of the Equipment that, in the discretion of the Released Parties, requires immediate or emergent medical attention, I hereby consent to the Released Parties obtaining medical care from any licensed physician, hospital or clinic, including transportation and emergency medical services, for me or my child(ren).
I understand that the Released Parties may take pictures and/or video of me or my child(ren) participating in the Programs and using the Equipment. Unless I notify the Released Parties by email to the contrary, the Released Parties may use my or my child(ren)'s photographs, images and/or likeness for any print or web advertising or other promotional purposes. I authorize the reproduction, sale, copyright, exhibit, broadcast, electronic storage and/or distribution of said photos, videos and sound recordings without limitation at the discretion of the Released Parties.
I understand that the Released Parties have rules and policies set in place to provide a safe and professional atmosphere during participation in Programs and use of Equipment. In registering for, and participating in the Programs and using the Equipment, I understand that my child(ren) and I must adhere to and follow any rules and policies as well as terms and conditions set forth by the Released Parties. The Released Parties reserve the right, in their sole discretion, to deny participation in the Programs or use of the Equipment to anyone.
I understand that the information provided on this form and/or in the online registration process will be maintained in an online account for our access to future Programs offered by the Released Parties.
I acknowledge that I have read, understand, and fully agree to the terms of this waiver and release and its contents. I understand and confirm that by signing this waiver and release, I have given up considerable future legal rights on behalf of myself and my child(ren). I sign this waiver and release voluntarily, under no duress or threat of duress, without inducement, statement, promise, representation, warranty, or guarantee being communicated to me. My signature is proof of my intent to execute a complete and unconditional waiver and release of all liabilities in force under the law. I am eighteen (18) years of age or older and mentally competent to enter into this waiver. I acknowledge that I sign this waiver for full, adequate, and complete consideration fully intending to be bound by the same.
If the individual participating in the Programs or using the Equipment is a minor, I am signing as a parent or legal guardian of said minor. I represent that I have full authority to enter into this waiver and release on behalf of my child(ren), realizing that this waiver and release is binding upon the minor child(ren) as well as myself. If the individual participating in the Programs or using the Equipment is under the age of eighteen, I acknowledge that such individual has read, understood, and discussed this release and waiver with me, and we hereby accept the terms and conditions stated in this release and waiver.
Etiquette and Rules
Parking
Please make sure you are ALWAYS parked in a legally marked parking spot. To help avoid traffic jams it is crucial that cars are NEVER parked in front of the main door. We ask that everyone alike follows this and keeps the entrance to the building clear. Additional parking available across the street in the Vanity Fair Outlet parking lot.
Etiquette & Rules
MTDS reserves the right to provide a substitute teacher should a teacher be absent for any reason. In the event that a substitution cannot be arranged, class may be canceled or rescheduled.
Classroom etiquette is expected at all times in the studio. Listening to your instructor, applying corrections and following the proper dress code are all standards in dance training. Courtesy and respect should be given to everyone at the studio, including teachers, classmates and parents. A positive attitude is CRUCIAL to our learning environment and will be assessed on an individual basis.
All students are encouraged not to leave the room once class has begun. Please allow for appropriate restroom use, water & snack breaks prior to the beginning of class. However, younger students will be treated more sensitively as these needs arise. ALL apparel changes, diaper changes, and bathroom needs must be completed in the bathroom, under ALL circumstances.
Observation of all classes is available on the TV monitor located in our lobby. We ask that you observe quietly and remain courteous of ALL classes in session. Please do not interrupt a class in progress!
Negative comments regarding instructors, other students, or parents in our space will not be tolerated. MTDS takes pride in creating a positive environment in which all students feel comfortable. In the occasion a problem arises, please contact the studio director Cortney Puza at your earliest convenience.
Care of Students
Motion The Dance Studio is not responsible for the care of students before or after class. For the children's safety, we also ask that parents come into the studio to pick them up. We do not allow children to go into the parking lot unaccompanied by an adult. Parking on the curb is prohibited! Parents, for your children's safety, please be in studio to receive students when they are dismissed from class. Motion The Dance Studio is liable for students from the start through the end time of their scheduled class only.
Lost or Stolen Items
Motion The Dance Studio is not responsible for lost or stolen items. Please check the bins in the lobbies for lost items. All items (except the donated shoes in the donation bin) will be donated every six months. Please make sure that all shoes and bags are labeled with the dancer's name.
Inclement Weather and Holiday Policies
In the case of inclement weather, please call the studio 508-995-2403 two hours prior to your scheduled dance class. Please note that MTDS follows the Dartmouth Public School System for all school calendar holidays, school closings, etc.
There are no refunds for absences or classes canceled due to weather. If a day of the week misses more than 2 days due to weather, MTDS will hold a class makeup day.
Costumes
Costume prices typically range from $65-$70 for Recreation level classes. Ballet/Tap Combo classes will have 2 costumes. Payments for costumes must be paid by November 30th. Tuition and costume payments must be up to date before costumes can be taken home. There are NO refunds after a costume payments have been charged.
Please note, costumes are not custom made and are purchased with room to grow based on a child's personal measurements and the costume company's size chart. Alterations, if necessary, are the parents' responsibility.
Rolling Admission
Classes run from September through June. A majority of our classes are open for rolling admission. New students may enroll at any time during the school year. A limited number of classes, including competition-based dance classes, have an enrollment deadline.
Refunds
There will be no refunds for a student's absence from class. If class enrollment does not exceed 4 students, the class will be cancelled and students will be reassigned to another class. Refunds will be issued only if the studio cancels a class and another class is not an option.
Levels and Placement
Each student is closely evaluated by the faculty. MTDS reserves the right to place each student in classes that are appropriate for their age, skill & overall demeanor.
Attendance
Attendance is extremely important in every class and is vital for student improvement and group choreography. Personal progress and growth as a class will reflect this. Please use your best judgment before sending your child to class if he or she has been ill. If students are injured, they should come to class and observe. If a dancer has inconsistent attendance, participation in performances are solely at the discretion of the teachers and the studio director.
MTDS values the importance of a dancer's growth during the entire dance calendar year which runs September - June. It inconveniences the instructor and impacts the quality of the class for other dancers if a dancer leaves before the recital showcase and completion of the year. If a dancer decides to discontinue a class after January 1st, a $50 cancelation fee will be applied automatically to that dancer's account to cover the choreography changes and time the class will use adapting to the change.

Parent's Responsibility & Awareness
It is the responsibility of the parents to be aware of all MTDS activities, performances, opening or closings, and special events. Notices are posted in studio, the website, social media and in any kind of newsletter sent home with students. All important notices are sent via e-mail as well.
