COVID WAIVER
Arabesque Dance Academy LLC has put in place preventative measures to reduce the spread of COVID19; however, Arabesque Dance Academy LLC cannot guarantee that you or your child(ren) will not become infected with COVID19. Futher, attending Arabesque Dance Academy LLC could increase your risk and your child(ren)'s risk of contracting COVID 19.
By signing this agreement, I acknowledge the contagious nature of COVID19 and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COVID19 by attending classes at Arabesque Dance Academy LLC and that such exposure or infection may result in personal injury, illness, permanent disability and death. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(re) or myself, illness, damage, lloss claim, liability or expense of any kind, that I or my child(ren) ay experience of incur in connection with my Children's attendance at Arabesque Dance Academy LLC programing or participation in programming. On behalf of my children, I hereby release covenant not to sue, discharge and hold harmless Arabesque Dance Academy LLC, its employees, agents and representatives of and from the claims including all liabilities, claims, actions, damages, csts or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any claims based on actions omissions or negligence of the studio, its employees agents and representatives, whether a COVID19 infections occurs before, during or after participation in any Arabesque Dance Academy LLC program
Tuition and Fees
Tuition is due no later than the first (1st) class of each month. A $20.00 late fee will be assessed for tuition collected after the 3rd of each month. There are absolutely no refunds or credits given for tuition, fees or for any reason. Student space in class will be forfeited after the 10th of the month, if tuition continues to be past due. Tuition is based on a yearly (10 months) tuition broken down into monthly installments. Summer is based on a 2 month fee broken down into monthly installments. Tuition is charged per month, not per class attended. There will be no prorated fees due to late start of missed classes. If your child misses a scheduled class, a make-up class can be taken within 30 days of the missed class (must reserve space in class and give prior notice.) No refunds will be given for classes missed (i.e. vacations, illness, weather, school activities, etc.). Tuition is non-transferable to other months or other students.
**Returned Checks: There will be a $25.00 service charge for all returned checks**
Tuition does not include recital/performance costumes, additional rehearsals, registration and recital/performance fees, recital/performance tickets, attire (including shoes, tights, and apparel), private and semi-private classes, traveling/lodging costs, or photography packages. There are absolutely no refunds, transfers, pro-rates or credits given for these fees and costs for any reason.
Recurring payment transactions are processed on the 3rd of each month (or next business day). If you decide to discontinue recurring payments for any reason, you will need to inform the office prior to the 1st of the month.
Withdrawal
To withdraw from a class, parent/ guardian must notify Arabesque Dance Academy of cancellation in writing, 14 days prior to removal. If you do not notify the studio in writing you will be assessed a fee equal to one month's tuition. Notification via social media messaging or text message will not constitute proper notice.
Withdrawal January through May: Should a student withdraw from class between the months of January and May a fee equal to $75 per class enrolled and per student withdrawn will be added to the student account. The fee will cover the cost to change choreography for dropped class to accommodate the class in which said student has withdrawn.
Missed Classes/Make-Up Classes
Make-up classes are available; however, you must notify the office prior to an absence from class to be eligible for a make-up class. The make-up class must be completed within thirty (30) days from the date of the missed class. Missed classes will not be applied toward future tuition. There are no refunds or credits for missed classes. Makeup classes will not be allowed after January each year due to preparing for the Spring Recital. The makeup class must be the same level of class missed.
Sick Policy: Students should remain fever, vomiting, and diarrhea free for at least twenty-four (24) hours prior to each class they attend. A student's participation in class with slight colds, allergies, runny noses, etc. will be at the discretion of the instructor.
Holiday/Vacations/Inclement Weather
Classes may be cancelled during holidays/vacations. Holiday/Vacation cancellations will be posted at least one (1) week before the holiday/vacation. The studio will observe the following breaks/vacations: 2 weeks during the summer 2 weeks during Christmas, 1 week during Spring Break, 2 week afters the Spring Recital (TBD), July 4th and Memorial Day. We will also observe Thanksgiving and the day after Thanksgiving. The studio will be open all other Holidays. In the case of inclement weather, we will follow the school closings for North College Hill City Schools. Please check our website www.arabesquecincinnati.com, Facebook Parent Page- Arabesque Dance Academy Parents Club, Facebook Page www.facebook.com/arabesquecincinnati, website: www. adancecincy.com and local news channels for weather related closings. There are no refunds/credits and tuition is NOT adjusted or prorated for holiday/vacation cancellations. Additionally, tuition will not be prorated or adjusted due to missed classes arising from family vacations, illness, school events, weather cancellations, etc. Makeup classes will only be given if time permits.
*should the studio need to close for natural disaster or pandemic, classes will be provided online in a virtual format. Tuition will still be due and not prorated for natural disasters or pandemics.
Viewing Policies
Viewing Area: Classes are closed for viewing purposes. Therefore, we encourage family members to attend performances and refrain from attending classes as we offer so many performances during the year.
Photography / Videography: For the safety and privacy of our students, no photography or videography can be taken during class without the instructor's approval and may be cause to have the person leave the premises and not to return.
Class Policies/ Parent & Student Conduct
Food / Beverages: Light and healthy snacks (i.e. fruit, vegetables, nuts, granola bar, etc.) are allowed by our students and encouraged if a student is in multiple classes. Fast foods must remain in the lobby. Water and sport drinks (i.e. Gatorade, Powerade, etc.) are the only beverages students are permitted to bring to class. A bottle of water will be provided to a student who needs or requests a drink from staff. The student's account will be charged $1.00 per bottle of water.
Disruptive / Disrespectful Behavior: Please treat this facility as if it were your home (i.e. pick up after yourself, your children, and your guests; monitor your children not in class; do not stand on chairs or put feet on walls, etc.). Any person who shows negative or disrespectful behavior, including but not limited to poor sportsmanship, rude and/or aggressive comments, toward any other person may be asked to leave the premises and not to return. This type of behavior may also lead to the student's account being immediately terminated without refund.
By Parents/Guardians/Bystanders: Please do not interrupt class for any reason, unless it is an emergency. (i.e. speak to a student or the instructor, parent/guardian coaching, parent/guardian discipline, etc.). If you would like to speak to the instructor, please leave a note for the instructor at the front desk, or contact them via email or telephone. Conversations with the instructor before or after class are also discouraged, as it takes preparation and class time away from the instructor and/or students who are attending the next class.
By Students: Unruly classroom behavior will not be tolerated from any student. Students participating in class shall not cause a disruption to the class, including but not limited to not paying attention in class, not listening to the instructor's direction, and/or actively causing a disruption in class. If such behavior occurs, the instructor has the discretion to respond in a manner reasonably necessary to regain the attention of the student and to stop the disruptive behavior, including but not limited to removing the student from class, brief time-out(s) for the student, and/or brief conditioning exercises (i.e. jumping jacks) for the student. There will be no refunds or credits given for missed time from class and if a student is asked to leave class, the class will be treated as a missed class.
Social media: students will represent the image of the studio at all times. They will not engage in inappropriate texting, posting or photos on social media. Students will use appropriate language when engaging with others via text and/or social media. Students will not add teachers as friends on social media accounts.
Hands On Facility
This is a hands on facility. This means physical contact that is reasonably intended to coach, teach or demonstrate a particular skill or to prevent or lessen injury (i.e. spotting, catching) will be used. Infrequent, non-intentional physical contact, particularly contact which arises out of an error or a misjudgment on the part of the student and/or instructor does not constitute physical abuse. We have not adopted any specific definition of abuse; rather, it defers to such general sources and definitions for reference and application, depending upon the circumstances and Ohio Revised Code
Additional Policies
Concerns/Complaints: Please understand that classes are back to back. Instructors are unable to take time from another class to answer questions about your child's progress and/or behavior or your parent account. Appointments can be scheduled with the director to discuss all questions and/or concerns during office hours and must be scheduled 24 hours in advance. There will be no pop-up meetings. If Students and/or parents that are disrespectful to other students, instructors and/or other Arabesque Dance Academy staff may be asked to leave studio. Arabesque Dance Academy reserves the right to refuse service. Please make sure that children waiting in the waiting area are quiet and are not running up and down the steps. If your student or a sibling is making too much noise, you may be asked to take them outside.
Video Surveillance: Areas of this facility are under video surveillance. Images may be collected that allow an individual to be identified. The use of video surveillance is solely for the purposes of controlling theft, ensuring the safety of instructors, staff, students and their families, and facilitating the identification of individuals who behave in a disruptive manner or cause damage to property.
Belongings: Arabesque Dance Academy is not responsible for lost/ stolen belongings. Please make sure your child has all belongings.
Medical Conditions/Injury: It is the student/ parent or guardian's responsibility to notify Arabesque Dance Academy of any medical conditions, student injuries. Arabesque Dance Academy is not responsible for student medical conditions or injuries.
Media Release
Arabesque Dance Academy students may be included in group/ individual photos for any of Arabesque Dance Academy websites and/or videos including recital photos and videos. I hereby grant permission for my child to be included in photo/video opportunities for the studio for the period of one year.
Releases & Waivers
I have enrolled in a program of strenuous physical activity, offered by Arabesque Dance Academy, L.L.C.. I hereby affirm that I am or the above person is in good physical condition and does not suffer from any disability that would prevent or limit participation in this dance program. In consideration of myself, my heirs and assigns, hereby release the Arabesque Dance Academy, L.L.C, the owner Kimberley R. Stewart, her family, her employers from any claims, demands, and causes of action arising from my or the above named person's participation in any of the above stated programs, and I hereby release Arabesque Dance Academy, L.L.C, the owner Kimberley R. Stewart, her family or employees, volunteers, and Limitless Performing Arts Co, L.L.C. from any liability now or in the future including but not limited to heart attacks, muscle strains, pulls, tears, broken bones, shin splints, heat prostration, knee, lower back, or foot injuries and any other illness, soreness or injury however caused occurring before, during or after participation in any other of the above stated programs offered at Arabesque Dance Academy, L.L.C or at any time, while in the vicinity of the premises of the above stated business, or in any activity sponsored, represented, or organized Arabesque Dance Academy, L.L.C, the owner Kimberley R. Stewart, her family, or employees, for any reason. By signing, I hereby affirm that I have read and fully understand and agree with the above waiver.
I am enrolling my child(ren)for Arabesque Dance Academy, L.L.C 2020 -2021 Dance Session. I understand that tuition is based on a yearly (9 month) tuition broken down into monthly installments. Should my child withdraw from classes, the remaining months of tuition must be paid. There are no refunds given for any reason and no prorate, discount or transfer of fees for missed classes due to weather, illness or vacation. I understand that if my child withdraws from the program, that all fees and deposits are 100% nonrefundable. By signing this form, the parent/adult is assuming any and all responsibility for the student, including financial obligations. I have received a copy of the studio policies, and has read and understands all policies
We, the staff at Arabesque Dance Academy L.L.C. and Limitless Performing Arts Co. recognize out obligation to make sure our students and their parents are aware of the risks and hazards involved in the sport of dance. By signing this waiver, you release Arabesque Dance Academy, Limitless Performing Arts Co., Kimberley R. Stewart and all of it's employees from all claims on account of any injury which may be sustained by your child while attending any dance class, event associated with Arabesque Dance Academy L.L.C. or Limitless Performing Arts Co, or outside performance. In signing this waiver, you also completely acknowledge your responsibility in paying monthly tuition, associated costumes, entry fees for performances and competition and all other communicated costs involved. You also affirm you now have and will continue to carry proper primary medical, health and hospitalization and accident insurance which you consider adequate for the protection of both your child and Arabesque Dance Academy L.L.C. and Limitless Performing Arts Co.
