Minor Consent and Assumption of Risk Statement
In consideration of registration at Melba's Inc. and being allowed to participate, the parent(s) and/or legal guardian(s) of the minor participant named below agreed:
1. Parent/Legal Guardian shall be instructed to and shall carefully review the following:
2. I/We fully understand and will instruct the minor participant that:
A. There are risks and dangers associated with participation in tumbling and dance events and activities including but not limited to those of bodily injury, partial and/or total disability, paralysis and death.
B. The social and economical losses and/or damages, which result from those risks and dangers described above, could be severe;
C. These risks and dangers may be caused by the negligence of the participant or the negligence of others.
D. There may be other risks not known to us or are not reasonably foreseeable at this time.
E. Melba's Inc. does not provide medical insurance for any child or participant. You are responsible for providing your own medical insurance.
Participation Release of Liability
In consideration of my child/ward being allowed to participate in the activities, programs, and instruction of Melba's Inc. (also known as Melba's School of Dancing), I/we hereby waive, release and forever discharge Melba's Inc., Melba's Dance School, Melba Huber, and their staff, instructors, officers, agents, employees, and representatives ("released parties"), from any and all responsibility or liability for any injury, accident, or disease occurring or arising from the instructional program, incidental sponsored activities, or team workouts, either on or off premises, whether due to the sole or concurrent negligence of third parties or the released parties.
Photography
I understand that Melba's makes class, practice, rehearsal, and performance moving visual, photographic, and other recordings of its students and I authorize Melba's to make and use any such recordings of Student for Melba's brochures, advertising, portraits, website updates, security evaluations, offers to students and families to purchase recordings, performance review and enhancement, and for archival and other Melba's business purposes. I understand that Melba's cannot make any exceptions to this policy because the recordings are made during class groups and class activities.
Permission for Medical Treatment
I/we authorize emergency first aid care to be administered to my child/ward by the School in the event he/she becomes injured or ill during, before, or after any instructional programs, incidental sponsored activities, or team workouts, either on or off the School's premises. If the parent(s) and/or guardian(s) of the child are not immediately available at the telephone numbers provided in this agreement, I/we further authorize Melba Huber, the school, or such agents as she may authorize, to retain the services of a doctor or other competent medical person in order to treat my child/ward.
I/we do warrant Melba's School of Dancing that the child herewith enrolled is physically and emotionally capable of motion exploration activities and is only limited as set out in the medical notes provided by us shown on this agreement. The school recommends that a complete physical examination be undertaken for the student before these activities.
Rules and Regulations
I/we do realize that said student must comply with reasonable Rules and Regulations promulgated by Melba's School of Dancing for conduct of instructional programs, incidental activities, and team workouts, either on or off the premises, for the mutual benefit of all students concerned. We understand and agree that all violations of said Rules and Regulations may be the basis of termination of student's enrollment and the school's obligation under this agreement. Participation in programs, recital or tumbling demonstrations, etc. will be based on attendance, attitude, ability, and cooperation of the student. Decisions regarding participation in these events will be made by the staff of the School at their discretion. Classes and times are subject to change.
Recital Fee
You will be responsible for a Recital Fee of $150 per performer. This fee is NON-REFUNDABLE and will be charged in December when Recital costumes are ordered. Once the fee has been added to your account, it must be paid in full by March 31. If your balance is not paid in full by March 31st, the recital fee will be automatically debited from the card on file.This charge includes any classes taught in May since May tuition will not be charged. The recital fee is also used to cover expenses throughout the school year for Recital preparation.
Costume Policy
A costume balance will be placed on your account 3 to 4 months prior to the performance. Once costumes are ordered they cannot be returned so you will not be refunded for your costume. Even if the recital is postponed, held virtually or classes are dropped, the costume balance must be paid in full on month prior to the event. This fee is NON-REFUNDABLE. Once the costume is ordered, you are responsible for the entire balance due. Students will not be allowed to perform in the Recital unless their costume balance is paid in full for all costumes.
Covid-19
Even though Melba's Dance School has procedures in place to prevent the spread of Covid-19, I/We do hold Melba's Inc. harmless in the event that my child or myself become inflicted with the Covid-19 virus or other viruses. Some of these safety measures include temperature checks, hand sanitizing stations, mandatory wearing of masks for Melba's Dance staff, parents and students. In spite of these preventative safety measures, I/we understand that they do not guarantee that I/we or my child will remain free of catching Covid-19 virus or other viruses. I/we assume this risk and hold Melba's Inc or Melba's Dance School harmless should I/we or my child catch the Covid-19 virus or other viruses. Furthermore, I/we recognize that these safety measures will be lifted when Melba's Dance School deems them no longer necessary to protect its staff and students.
Melba's Inc and Melba's Dance School reserves the right to dismiss a student from class if they have a fever above 100 degrees fahrenheit or demonstrate symptoms of viral illness.
Virtual Classes and Recordings
For privacy reasons, DO NOT share links to virtual classes or class recordings. We require all participants to register for the class on our website to receive a link to access the online content. When using an interactive platform, like Zoom, the video and audio from all participants is shared and may be captured if a class is being recorded. While we usually try to only record the view of the "presenter", you are responsible for muting your own microphone and camera. Failure to turn off any microphone or video camera will constitute consent to Melba's Dance recording any audio or video content. Melba's Dance will not be held liable for inadvertent recording of audio or video content or dissemination of said content. Virtual Classes may be created, modified or cancelled at any time during Melba's dance school year.
Tuition Policy and Automatic Draft
Tuition is due on the 1st of every month. It will be automatically drafted between the 1st and 5th of every month.
If a student attends one class in a month, you are responsible for the full month of tuition. Attendance applies to both in-person and virtual attendance. Melba's does not refund tuition for any reason and will not refund for those who are out with illness or dismissed from class due to illness. Tuition is only prorated for registration purposes. Melba's will not prorate tuition in any other month.
If it is necessary to to change, drop or withdraw your child from the school, you must call Melba's Dance Shoppe to formally withdraw. Failure to withdraw will result in continued liability for tuition payments. If payment has not been received by the 10th of the month, a $15 late fee will be assessed and automatically billed to your account.
Tuition must be current to participate in any Melba's performances.
Release of Liability for Virtual Classes
Agreement to this Liability Waiver will act as your continued agreement to all ensuing sessions, workshops and/or seminars whether in person, via FaceTime, Zoom or any other video conferencing tool.
Service
Melba and Melba's Inc. reserves the right to refuse service to anyone. Should any part of this document be deemed illegal, the remainder of this document will remain in force.
