Waiver and Release of Liability
In consideration of being allowed to participate in any way in any dance instruction, dance rehearsal or dance performance or related events of Studio Five Dance Company LLC ("dance activities"), the guardian hereby acknowledges, appreciates and agrees that there is a risk of injury, including physical injury or death, from the activities involved in the dance activities. The guardian hereby GIVES PERMISSION FOR THEIR SELF/CHILD TO PERFORM DANCE ACTIVITIES including but not limited to complicated dance moves, jumps, stunts, lifts, flips or other gymnastic activities in the studio, in any and all rehearsals and performances, and at home through online instruction. The guardian KNOWINGLY AND FREELY ASSUMES ALL SUCH RISKS, both known and unknown, AND ASSUMES ALL RESPONSIBILITY of my or my child's participation in all the activities of the studio, including all dance activities, EVEN IF ARISING OUT OF THE NEGLIGENCE OF the studio officers, officials, personnel, agents, employees, contractors, assistants, guest artists, volunteers, students, other participants, or owners and lessors of the premises ("the Releasees") and the guardian assumes full responsibility for myself or child's participation. I, for myself and on behalf of my heirs, assigns, representatives and next of kin, HEREBY RELEASE, INDEMNIFY AND HOLD HARMLESS Studio Five Dance Company, LLC, their officers, officials, personnel, agents, employees, contractors, assistants, guest artists, volunteers, students, other participants, and owners and lessors of the premises with respect to any and all injury, disability, death or loss or damage to person or property whether arising from the negligence of the Releasees or otherwise to the fullest extent permitted by law. I further certify that I have legal responsibility for any minor child I am registering and have the right to waive these rights. Studio Five Dance Company LLC is not responsible for students who choose not to attend class after being dropped off, or choose to the leave the studio proceeding, during or following a scheduled class. This waiver and release is applicable to any child or other person in the care of the guardian while on the studio property.
I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
Permission to Give Medical Treatment
I give permission for any medical treatment that may be necessary in the studio's discretion as a result of the student's participation and in the absence of me or other guardians to give permission at the time.
Enrollment and Tuition
Enrollment: Guardian hereby enrolls their student at Studio Five Dance company for dance instruction for the 2020-2021 season. The 2020-2021 season is August 24, 2020 - June 6th, 2021. You are registering for the entire season and making a commitment to the aforementioned dates.
Registration Fee: Guardian hereby tenders the NONREFUNDABLE registration fee of $40.00. A registration fee does not apply for summer sessions. Registration fee does not include recital tickets.
Tuition: Tuition is based upon the entire season and is broken into 10 equal payments for your convenience. The payments will run from August 2020 - May 2021. YOU ARE NOT PAYING A MONTHLY TUITION. Seasonal tuition will be prorated based on remaining contract length for any families enrolling after the season begins. Costumes and recital fees such as tickets, t-shirts, DVDs, flowers, yearbooks, pictures, etc. are not included in your tuition. You will be able to purchase recital tickets directly from the recital ticketing program. Guardian shall pay the disclosed amount (tuition) agreed upon by the studio and the guardian. Tuition payments are due on the first of the month, and will be automatically drafted from your form of payment on file.
Transition to Virtual Classes Due to Government Regulations: If Studio Five must transition to temporary virtual classes due to Government restrictions preventing us from meeting in-person, tuition fees still apply to full price and will not be refunded if you choose not to attend virtual classes.
Return Fees: If you need to change any payment information, you can do that through your parent portal or in the office before the 25th of each month. Any payments returned or notification of NSF (by a financial institution or the guardian) as unpaid for any reason, or credit card/bank account decline will be assessed a return fee of $35.00 if not corrected/paid by the 10th of the month.
Payment Due: Upon registration, the total amount of one month's tuition will be due. In the case of a late registration (after the month has already started), the current tuition rate will be prorated for that month and due upon registration in addition to the registration fee. Enrollments receiving any discounts through studio promotions are not subject to prorated tuition. Registrations received on or after the 25th of the month will be billed for the following month's tuition. A bank account or credit card is required to remain on file. Visa/Mastercard/Discover/AMEX are accepted and are subject to a 3% credit card processing fee for any and all transactions. Bank draft is the preferred method of payment.
Costumes
All students registering are required to participate in the annual spring recital, held in June. For each class in which a student is enrolled, there is a mandatory costume fee that will be charged to your account. 50% of the total costume fee will be automatically drafted from your account on October 15th. 50% of the total costume fee will be automatically drafted from your account on November 15th. Costume fees must be $0 before the Studio will order your child a recital costume. Costumes will be distributed in February during class times. Picture week will be scheduled for March or April. Students registering after December 1st may be charged a late order fee of $10.00 for their costumes. Students registering after December will be required to pay for the their costume up front, as those fees were paid in October and November. Late order costumes may arrive after class distribution. (Not applicable for company dances) (Costume are not applicable for summer session)
Dress Code
Students are required to wear tights to all jazz, lyrical, modern, and ballet classes.
Students in hip hop, tap, and clogging classes should wear comfortable clothing that is easy to move in.
Proper shoes (color and style) are required for all classes. Students should wear their shoes to every class.
Ballet class dress code is pink tights and a leotard. Students may wear a ballet skirt or shorts over the leotard. T-shirts, sweatpants, baggy clothing are not acceptable ballet attire.
All students should have their hair up and out of their face. Hair should be secure and should not need to be restyled through out the class. Hair should be in a proper ballet bun for ballet classes.
Inclement Weather/COVID Polices
In case of inclement weather, we operate on the Wake County Public School policy. If Wake County Schools are closed due to inclement weather, the studio will be closed also, unless we inform otherwise. Classes will be held via Zoom in the Online Dance Academy. We do not refund or pro-rate tuition due to inclement weather closings.
Should the studio be closed to students due to COVID or some other pandemic or disaster, classes will immediately pivot to the Online Academy. Classes will be run on their normal schedule LIVE through Zoom. Tuition will not be refunded or pro-rated. Parents will be emailed the link to the Zoom class 30 minutes prior to the start of class.
Photography/Video Release
Guardian agrees that the student may be photographed or video taped during studio activities, including but not limited to, performances, classes, rehearsals, and such images are the property of the studio. These photographs may appear in advertisements, website, social media, or inside the property for any purposes the studio desires.

Withdrawal and Termination of Contract
Termination of Contract: Upon entering this contract, you are committing to the entire dance season (August 2020 - June 2021). Our teachers invest in your students by building relationships, developing their skills, and creating an inclusive and personalized environment for all dancers. Withdrawing your student before the completion of the season causes a disruption to the classroom environment. Due to the administration time required to refill your child's spot, this termination policy is in effect. Should you desire to terminate your contract with us, you will be assessed a $150.00 cancellation fee, due at the time of withdrawal in addition to any outstanding balances.
Withdrawal: Your student will be immediately dropped from our rosters upon receipt of your written withdrawal notice and no fees (registration fee, tuition, or costumes) will be refunded. If a costume has been ordered for your student and you withdraw before it has been distributed, it will be available for pick-up in March 2021 and must be collected before May 1, 2021. Costumes not collected after May 1, 2021 will be surrendered to the studio.
60-Day Happiness Guarantee: Families new to Studio Five Dance Company who are withdrawing and terminating their contract within the first 60 days are not subject to the $150.00 cancellation fee. No fees paid will be refunded.
Cancellation Fee Exemptions: Families required to suddenly move away from the area resulting in their withdrawal may request an exemption from the cancellation fee with the Office Manager upon providing a proof of new address.
Termination of Contract by Studio Five: The studio, it's officers, and it's employees may at any time, for whatsoever reason deemed necessary by the studio, terminate this contract and the enrollment of a student(s) that it pertains, without notice to, or recourse by guardian. No refunds will be given to any students dismissed from the studio.
COVID-19 Liability Release Waiver
In consideration of participation at Studio Five Dance Company through any and all of their programs and classes offered, the undersigned acknowledge and agree to the following:
I am aware of the existence of the risk on my/my child's physical appearance to the venue and my/my child's participation in the activity of Studio Five Dance Company that may cause injury or illness such as, but not limited to Influenza, MRSA, or COVID-19 that may lead to paralysis or death.
I/my child have not experienced symptoms including, but not limited to, fever, fatigue, difficulty in breathing, or dry cough, nor are exhibiting any other symptoms relating to COVID-19 or any communicable disease within the last 14 days.
I/my child have not, nor any member(s) of my household, traveled by sea or by air, internationally within the past 30 days.
I/my child did not, nor any member of my household, visit any area within the United States that was reported to be highly affected by COVID-19 in the last 30 days.
I/my child have not been, nor any member(s) of my household, diagnosed with the COVID-19 virus within the last 30 days.
I/my child understand that there may be times for necessary physical contact with teachers or staff members for safe dance practices and social/emotional wellness.
Following the pronouncements above, I hereby declare the following:
I am fully and personally responsible for my/my child's own safety and actions while and during participation and I recognize that I/my child may in any case be at risk of contracting COVID-19.
With full knowledge of the risks involved, I hereby release, waive, and discharge Studio Five Dance Company, its board, officers, independent contractors, affiliates, employees, representatives, successors, and assigns from any and all liabilities, claims, demands, actions, and causes of action whatsoever, directly or indirectly arising out of or related to any loss, damage, injury, or death that may be sustained by me/my child related to COVID-19 while participating in any activity while in, on, or around the premises or while using the facilities that may lead to unintentional exposure or harm due to COVID-19.
I agree to indemnify, defend, and hold harmless Studio Five Dance Company from and against any and all costs, expenses, damages, lawsuits, and/or liabilities or claims arising whether directly or indirectly from or related to any and all claims made by or against any of the released party due to injury, less, or death from or related to COVID-19.
