Assumption of Risk
I, on behalf of my child, myself, my heirs, representatives, and assigns, hereby release and hold harmless American Flip Factory, LLC, it's owners, officers, agents, employees, volunteers, or participants, sponsoring agencies and advertisers from any and all claims for injury, disability, death, loss or damage to person or property, whether arising from inherent risks or from ordinary negligence of the releasees mentioned herein or otherwise.
Release of Liability
RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT ("AGREEMENT")
RELEASE FOR CHILD TO BE CONSENTED BY PARENT:
In consideration of participating in classes at American Flip Factory, LLC I represent that I understand the nature of this activity and that my child(ren) are qualified, in good health, and in proper physical condition to participate in such activity. I acknowledge that if I believe event conditions are unsafe, I will immediately discontinue my child(ren)s participation in the activity. I fully understand that this activity involves risks of serious bodily injury, including permanent disability, paralysis and death, which may be caused by my child(ren)s own actions, or inactions, those of others participating in the event, the conditions in which the event takes place, or the negligence of the "releases" named below; and that there may be other risks either not known to child(ren) or not readily foreseeable at this time; and I fully accept and assume all such risks and all responsibility for losses, cost, and damages my child(ren) incur as a result of their participation in the activity.
I hereby release, discharge, and covenant not to sue American Flip Factory, LLC, it's respective administrators, directors, agents, officers, volunteers, and employees, other participants, any sponsors, advertisers, and if applicable, owners and lessors of premises on which the activity takes place, (each considered one of the 'RELEASEES" herein) from all liability, claims, demands, losses, or damages, on my child(ren)s account caused or alleged to be caused in whole or in part by the negligence of the "releasees" or otherwise, including negligent rescue operations and future agree that if, despite this release, waiver of liability, and assumption of risk my child(ren), or anyone on their behalf, makes a claim against any of the Releasees, we will indemnify, save and hold harmless each of the Releasees from any loss, liability, damage, or cost, which any may incur as the result of such claim.
I have the read the RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT on behalf of my child(ren), understand that my child(ren) and I have given up substantial rights by signing it and have signed it freely and without any inducement or assurance of any nature and intend it to be a complete and unconditional release of all liability to the greatest extent allowed by law and agree that if any portion of this agreement is held to be invalid the balance, notwithstanding, shall continue in full force and effect.
PARENTAL CONSENT:
AND I, the minor's parent and/or legal guardian, understand the nature of the above referenced activities and the Minor's experience and capabilities and believe the minor to be qualified to participate in such activity. I hereby Release, discharge, covenant not to sue and AGREE TO INDEMNIFY AND SAVE AND HOLD HARMLESS each of the Releasees from all liability, claims, demands, losses or damages on the minor's account caused or alleged to have been caused in whole or in part by the negligence of the Releasees or otherwise, including negligent rescue operations, and further agree that if, despite this release, I, the minor, or anyone on the minor's behalf makes a claim against any of the above Releasees, I WILL INDEMNIFY, SAVE AND HOLD HARMLESS each of the Releasees from any litigation expenses, attorney fees, loss liability, damage, or cost any Releasee may incur as the result of any such claim.
Payment Policies
Accounts will be drafted on the 25th of each month for the following months tuition. If you choose not to auto draft, tuition is due by the 25th of each month. Statements are e-mailed on or before the 20th of each month. If you choose to pay after the 3rd, there will be a $15.00 late fee charged to your account. If payment is not received by the 2nd week of the month, your child will be dropped from the class. Checks may be payable to American Flip Factory. Credit card payments may be made online for free, or over the phone with a $2.00 processing fee.
Family Discount: Beginning with the second child enrolled, you will receive a $10.00 discount per child.
Annual Registration Fee: All members of American Flip Factory, LLC are required to pay an Annual Registration Fee. This fee is non-refundable. Fees are prorated throughout the year according to the month you enroll.
Monthly payments will be drafted from the credit card or debit card of your choice. We will automatically draft your account each month on the 25th of the month for next months tuition. If you decide to leave American Flip Factory, LLC please give us written notice by the 15th of the month so we can stop the auto draft for the following month.
If you choose not to use our auto draft option, a security deposit will be required at registration per child. This deposit will be held in your account and used toward your last months' tuition if you should ever decide to leave the gym. You MUST give a written notice by the 15th of the month in order to use the deposit. Otherwise, it will be forfeited.
Privacy Policy of payment information. All credit card/bank draft information is kept in a locked secure place, and or stored securely online. At the end of each year, all payment information is shredded and destroyed. American Flip Factory, LLC is the only company to use the information for it's intended purpose. It will never be shared with other parties.
Declined Drafts: If your draft is declined, you will receive a $30.00 decline charge.
Medical Emergencies
I fully understand that the staff of American Flip Factory, LLC., are not physicians or medical practitioners of any kind. With that in mind, I hereby release American Flip Factory, LLC., to render first aid to my child in the event of any injury or illness, and if deemed necessary to call an ambulance which I agree to pay for. As a parent or legal guardian, I agree to provide health insurance for the minor child and/or guarantee payment of any medical expenses incurred as a result of training, performing, or participation in activities with American Flip Factory, LLC.
Does your child have any medical conditions (mental or physical) or medications we should be aware of, including but not limited to; breathing problems, seizures, allergies, Downs Syndrome, dizzy spells, previous neck or spine injuries or conditions, broken bones, high blood pressure, diabetes, autism, epilepsy, heart condition etc.***ALL ABOVE CONDITIONS REQUIRE A DOCTORS RELEASE claiming your child is fit enough to take "GYMNASTICS","TUMBLING", "CHEER", "NINJA WARRIOR" .
The undersigned gives permission for American Flip Factory owners, officers, employees, and/or agents to seek emergency medical treatment for the participant(s) in the event they are unable to reach any parent or guardian. The undersigned also agrees that they themselves will be responsible for any financial debt incurred by said action.
Marketing Release
I understand that my child's photo/videos may be used in American Flip Factory ads, promotional videos, website material, or various other marketing. These images, audio, or recording will be used for American Flip Factory's purposes only, and will not be given or sold to outside companies or individuals.
Make ups and Holidays
When you register your child for a class, you are paying for your child's place in that class, not their attendance. We do not promise or owe credit for missed classes. However, we understand that children get ill; therefore we will offer your child make-up classes during the month that your child was absent. One make-up class may be carried over into the next month. Make-up classes must be scheduled through the front office and will be granted upon availability in a class. All make-ups must be completed while the child is still enrolled. Accounts with outstanding tuition payments will NOT be eligible for make-up classes.
Holidays: There will be no prorating for holidays. I understand tuition is based on an annual session of August through July. Throughout the annual session, 48 weeks of classes will be offered. The number of classes in each month may vary. Therefore, the monthly tuition is a flat charge and full tuition is due regardless of the number of classes offered that month. For 2020-2021 calendar, American Flip Factory will be closed Monday September 7th in observance of Labor Day, November 25th-28th for Thanksgiving, December 21st through January 2nd, May 31st through June 5th.
Annual Registration Fees
Individual Registration Fee is $35.00 due upon enrollment in order to reserve classes.
Family Registration Fee is $55.00 due upon enrollment in order to reserve classes
COVID-19 Waiver
I understand that while American Flip Factory, LLC. attempts to provide the cleanest possible environment to mitigate the risk of contagions, there is no 100% guarantee that all contagion is eliminated, including COVID-19. I assume the risk for myself and my child in participating in activities at American Flip Factory, LLC.
