Liability Release
I am aware that dance training and the athletic exercises associated with it place unusual stress on the body and carries a risk of physical injury. On behalf of my child and myself (and if I am no longer a minor, on my own behalf), I assume the risk and agree that Goh Ballet Academy shall not be liable in any way for injuries sustained during attendance, dance class or any related functions. I understand that good dance training involves touching and adjustment of the student's body by the instructor. I further acknowledge that neither Goh Ballet Academy nor its instructors are responsible for any loss of or damage to the student's personal property.
External Training/Performances/Participation
I fully understand that any participation in programs/ classes/ performances/ competitions/ dance related projects held or presented by an organization outside of Goh Ballet must be discussed with my main teacher and permission from the Academy's Director is required to participate in such activities. This permission may be obtained by filling out the paperwork that is available from the Administrative Office.
Medical Release
In the event that I cannot be reached, I hereby give my permission to the management, faculty, administration, staff and chaperones of Goh Ballet Academy to authorize any emergency medical care that may be required by the above noted student during participation in classes, performances, or any related Goh Ballet Academy events. This authorization extends throughout my or my child's enrollment with Goh Ballet. I understand that I am responsible for any and all charges as a result of such care or medical treatment. I understand that if the student requires an epinephrine pen administered in the event of an allergic reaction a letter detailing permission of administration is required. Without this letter, epinephrine cannot be administered by any Goh Ballet faculty members under any circumstances. If a student requires prescription medication for any reason, a letter of permission of administration is required, without this letter, the Goh Ballet Faculty will not administer any prescription medication.
All international students must have valid Medical Insurance while studying with the Goh Ballet Academy and the cost of which is the sole responsibility of the student.
Health & Safety Self-Screening Acknowledgement
For the safety of all, Goh Ballet requires all students and families to self-screen prior to coming to the Academy for any reason.
I/We here by acknowledge that I/we have and will conduct self-screening prior to coming to the Academy for classes.
I/We will self-screen and all those in my household every day for the following:
- Coughing that cannot be attributed to allergies
- Nasal congestion or runny nose that cannot be attributed to allergies
- Fever > 37.5°C
- Headache
- Muscle pain
- Shortness of breath
- Loss or reduced sense of taste or smell
If any of the above symptoms are present I will contact Goh Ballet's Administrative Office and stay home until symptoms subside.
I/We also acknowledge that Goh Ballet Administrative Staff will screen me and/or my child upon entry into the Academy each day and if I exhibit any of the above symptoms that I will be sent home. I/my child will always do our best to practice proper physical distancing and such practices have been discussed at home. I/my child will practice proper hygiene, which includes coughing or sneezing into my elbow, not sharing my food or drinks, and adhering to instructions by Goh Ballet teaching and administrative staff and washing our hands properly and frequently. In addition, if any of the following have taken place, I agree to inform the Academy's Administrative Office that I/my child will be in quarantine for a minimum of 14 days:
- I/my child have/has been, or a member of my household has been, travelling outside of B.C.
- I/my child have/has been in contact with someone experiencing the above symptoms
- I/my child have/has been in contact with someone suspected of having COVID-19
- I/my child have/has been in contact with someone diagnosed with COVID-19
Cancellation and Refund Policy
Enrollment in the Annual, Summer and All programs is a commitment to pay the entire tuition amount. Tuition is non-refundable, non-transferable and no refunds or credits will be given for missed classes or early withdrawal. All outstanding installment payments will become due and will be automatically charged to the credit/debit card/bank account on file on the dates outlined in program packages. Should the payment not go through to the card or bank account we have on file an alternative method of payment will be required within 7 days of the payment due date to avoid penalty charge of $50 per payment and /or interest of 2% per month. If any applicable laws, including but not limited to orders of the provincial health officer, prevent in-studio training, or if Goh Ballet deems it unsafe to carry out in-studio training, I agree that material changes in delivery of any programs will not entitle me to a refund. Students who must discontinue training prior to the end of the school year for any reason must notify the Accountant, or Administrative staff member as soon as possible in writing. In all cases, a student must notify the office if he/she is unable to attend class.
Tuition Payment Agreement
I/We understand that registration fees, deposits, and tuition fees are non-refundable and non-transferable. I agree to pay to Goh Ballet Inc. (Vancouver) or Goh Toronto Inc. (Toronto) the entire amount of any applicable tuition, private lesson, performance, costume, competition, extra class or tutorial fees and all other fees arising from the registration of myself or my child with Goh Ballet Inc., at the published rates.
An administration fee of $50.00 will be applied to NSF pre-authorized debits and invalid, expired or declined Visa or MasterCard charges or cheques. I understand that if my tuition payment is not remitted on time, I (or my child) will not be allowed to participate in classes until the amount owing is paid in full. I understand that interest will be applied on all overdue accounts after 7 days at a rate of 2% interest per month.
Pre-Authorized payment Terms & Conditions Agreement (1-8)
1. In these Pre-Authorized Payment, Terms and Conditions (the "Agreement"):
a. "Account" means the account we have specified to Goh Ballet Inc./Goh Toronto Inc. at the time of our acceptance of this Agreement, or such other account as we may specify on the terms set out herein;
b. "Credit Card" means the credit card specified to Goh Ballet Inc./Goh Toronto Inc. at the time of our acceptance of this Agreement, or such other credit card as we may specify on the terms set out herein;
c. "PAD" means a pre-authorized debit from the Account;
d. "PAP" means a pre authorized payment via either PAD or Pre-Authorized Charge;
e. "Pre-Authorized Charge" means a pre-authorized charge to the Credit Card authorized hereunder; and
f. "we", "us" and "our" refer to the account holder(s)/payor(s) indicated herein.
2. We authorize Goh Ballet Inc./Goh Toronto Inc. to charge to our Credit Card or withdraw from our Account, recurring or one-time payments of tuition, private lesson, performance, costume, competition, extra class or tutorial fees and all other fees arising from the registration of ourselves or our child with Goh Ballet Inc./Goh Toronto Inc.. We agree that such recurring charges or debits will be made following the issuance of Goh Ballet's invoices to us, and the charges or debits will be in the amount stated in such invoices, which amounts may vary in accordance with variations in amounts billed by Goh Ballet Inc./Goh Toronto Inc.
3. We hereby waive any and all requirements for pre-notification of debiting of a PAD hereunder.
4. This Agreement is provided for the benefit of Goh Ballet Inc./Goh Toronto Inc. and our financial institution and is provided in consideration of our financial institution agreeing to process personal debits against our Account in accordance with the Rules of the Canadian Payments Association. We agree that any direction we may provide to complete a PAP, and any PAP made in accordance with this Agreement, shall be binding on us as if signed by us.
5. We acknowledge that we will receive invoices for services and products provided by Goh Ballet Inc./Goh Toronto Inc.. We acknowledge and agree that receipt of email notice serves as notice of the date and amount of the PAP and that the notice may, in some instances, be received less than ten (10) calendar days before or after the date of the PAP.
6. We acknowledge that, while Goh Ballet Inc./Goh Toronto Inc. will normally charge PAPs to our Account or Credit Card within three days after it renders its account billing, the dates on which Goh Ballet Inc./Goh Toronto Inc. will draw PAPs against our Account or charge our Credit Card may vary from time to time in accordance with Goh Ballet's normal billing and processing procedures. We authorize Goh Ballet to draw PAPs and our financial institution to process such PAPs on different dates or days of the month from time to time without any pre-notice to us or any other consent by us. In the event that any PAP is not honoured, due to non-sufficient funds or other reasons (other than our revocation of this Agreement or non-compliance of the PAP with this Agreement), we authorize Goh Ballet Inc./Goh Toronto Inc. to re-submit the PAP within 30 days of the date of dishonour without any notice to or consent by us.
7. We certify that all personal and Account or Credit Card information submitted concurrently with the acceptance of this Agreement is accurate. We agree to inform Goh Ballet Inc./Goh Toronto Inc., in writing, of any change to the information provided in this Agreement at least fifteen (15) days prior to the next Goh Ballet billing date. In the event of any change, this Agreement shall continue to apply in respect of any new Account, Credit Card or financial institution to the same extent as if they had been shown on the signed form. We guarantee that the signatories to any written notice of change we provide to Goh Ballet will be all such persons as would be required to sign any cheque drawn on or authorize any charge made to the new Account or Credit Card.
8. We take responsibility for the accuracy of information provided to Goh Ballet Inc./Goh Toronto Inc. herein. Goh Ballet Inc./Goh Toronto Inc. will not be responsible for or liable to us or any third party for any errors, delay, damage, loss, liability, inconvenience or claim whatsoever related to information provided by us to Goh Ballet. In the event of an error, Goh Ballet Inc./Goh Toronto Inc. may take appropriate action to remedy the situation.
Pre-Authorized payment Terms & Conditions Agreement (9-16)
9. We agree that our financial institution is not required to verify that any PAD has been drawn in accordance with this Agreement, including the amount, frequency and fulfillment of any purpose to which the PAD relates. We agree that delivery of this Agreement to Goh Ballet Inc./Goh Toronto Inc. constitutes delivery by us to our financial institution, and that Goh Ballet Inc./Goh Toronto Inc. may deliver a copy of this Agreement to Goh Ballet Inc.'s/Goh Toronto Inc.'s financial institution for the purpose of processing PADs, and we consent to the disclosure of any information contained in this Agreement to such financial institution.
10. Our authorization hereunder will remain in effect until we have notified Goh Ballet Inc./Goh Toronto Inc. in writing of its cancellation in Vancouver to Goh Ballet Academy, 2345 Main Street Vancouver, BC V5T 3C9, or by email to reception@gohballet.com and in Toronto to Goh Ballet Bayview, Unit 127A, 2901 Bayview Avenue, Toronto, ON M2K 1E6 or by email to bayview@gohballet.com. Goh Ballet must receive our notice of cancellation at least fifteen (15) business days prior to the date the next debit or charge is scheduled to be made hereunder. We acknowledge that cancelling this Agreement without providing a new payment method may result in the student being unable to participate in classes or other Goh Ballet activities. For PADs, we acknowledge that we can obtain a sample PAD cancellation form or further information on our right to cancel a PAD from our financial institution or by visiting www.payments.ca. Any cancellation of this Agreement applies only to the method of payment; cancellation of this Agreement does not terminate or vary in any way any contract or terms of service between us and Goh Ballet Inc./Goh Toronto Inc., including but not limited to our obligation to make agreed payments to Goh Ballet Inc./Goh Toronto Inc. and to comply with the Cancellation Policy.
11. In respect of a PAD, we have certain recourse rights if any debit from our Account does not comply with this PAP Agreement. For example, we have the right to receive reimbursement for any debit from our Account that is not authorized or is not consistent with this PAP Agreement. To obtain more information on our recourse rights, we may contact our financial institution or visit www.payments.ca.
12. We may dispute a PAD drawn on our Account where: (i) the PAD was not drawn in accordance with this Agreement, or (ii) this Agreement was revoked by us. In order to obtain reimbursement by our financial institution for a disputed PAD, we must sign the required form of declaration and deliver it to our financial institution in accordance with Rule H1 of the Canadian Payments Association. In the case of "personal" PADs as defined in Rule H1, which includes PADs for residential accounts, the specified period is 90 calendar days after the date on which the disputed PAD was drawn on our Account, and in the case of "business" PADs as defined in Rule H1, which includes PADs for commercial and industrial accounts, the specified period is 10 business days after the date on which the disputed PAD was drawn on our Account. We acknowledge that if notice is not given in accordance with Rule H1 within these specified periods, any dispute regarding a PAD must be resolved solely with Goh Ballet Inc./Goh Toronto Inc. and that our financial institution will have no liability to us with respect to any such PAD.
13. We understand and accept the foregoing terms and conditions, and agree to participate in a pre-authorized payment arrangement in accordance with this Agreement.
14. We agree to comply with the Rules of the Canadian Payments Association now or hereafter in effect in relation to PAD authorizations and agree to sign any further documentation that may be required pursuant to such rules.
15. We confirm that all persons whose signatures are required to sign on the Account have electronically signed this Agreement.
16. This Agreement may be signed electronically, and a signed copy of this Agreement transmitted by email or other electronic means is deemed to be an original hereof.
Fundraising/Volunteerism Expectation
Fundraising is an important and ongoing component of the Goh Ballet. Funds to support developing programmes and capital expansion come from donations and fundraising events. It is understood that Parents/Guardians of children enrolled in Goh Ballet become members of the Goh Ballet family 'community', which is committed to the support of and participation in fundraising activities, without which we could not achieve the high standards we have set for the academy.
Goh Ballet also thrives with the volunteer assistance from Parents/Guardians and friends. If you have any special interests or skills that you are willing to share with Goh Ballet, please notify the administrative office. Our aim at Goh Ballet is to open every window of opportunity for every student, and your gifts and talents are appreciated.
Publicity Release
I, the undersigned, do hereby grant permission to Goh Ballet Academy, Goh Ballet Inc. Goh Toronto Inc and its licensees, successors and assigns (collectively called the "Licensed Parties") worldwide, absolute, and irrevocable permission to use, reproduce, post, print, and/or publish my or my child's name, likeness, image, voice, and/or appearance ("the Material") in any media, including but not limited to photographs, video recordings, audiotapes, digital images in which I may be included intact or in part, composite or distorted in character, sound or form, without restriction as to changes or transformations in conjunction with my own or a fictitious name, or reproduction hereof. I agree that the Material may be used for any purpose consistent with the Goh Ballet's mission, programs, productions or performances, including in news releases, advertisements, social media, publications, marketing campaigns, media coverage, videos, websites, billboards, and any other promotional or educational materials compiled by or on behalf of the Goh Ballet.
I understand and agree that Goh Ballet has and will have complete ownership of the Material and that I will not receive any compensation for the use of the Material. I hereby release the Licensed Parties from any and all claims arising out of their use of the Material as agreed to in this document, including without limitation any claims based on the right of publicity or privacy, misappropriation or misuse of image, and/or defamation, including liability by virtue of any blurring, distortion, alteration, optical illusion, or use in composite form whether intentional or otherwise. I further hereby waive any future right to prior review of any use of the Material.
Discount Plan
The 2nd and subsequent family members will receive a 10% discount on their additional set of tuition. *Families are responsible for notifying the administrative office of such a situation in order to receive this discount. The program of instruction does not require approval under the Private Training Act; and student may not file a claim against the fund with the trustee in respect of the program of instruction.
Digital Learning Materials Terms of Use
I acknowledge Goh Ballet may, from time to time, provide supplemental learning resources via video or live-streamed classes. When such materials are provided, I acknowledge Goh Ballet grants my child and our household the right to use such materials for the sole purpose of supporting and furthering my child's ballet training and that I will not share, distribute, or abuse any of the content my child and our household has been given access to. I acknowledge all Goh Ballet's digital learning materials are copyrighted and the intellectual and artistic property of Goh Ballet. Any unauthorized reproduction or distribution of said work, including any such activities without monetary gain, is illegal, and will result in an immediate revocation of access to Goh Ballet's eLearning materials.
I have read, understood and agreed to the Liability Release, Medical Release, Cancellation Policy, Tuition Payment Agreement, Pre-Authorized payment Terms & Conditions, Publicity Release, Discount Plan and Digital Learning Resources Terms of Use. The undersigned also understands and agrees that the Academy reserves the right to void this membership for conduct that contravenes the objectives, rules, regulations and policies of the Academy as outlined in the student handbook.
