Covid-19 Release
WAIVER/RELEASE FOR COMMUNICABLE DISEASES INCLUDING COVID-19
ASSUMPTION OF RISK / WAIVER OF LIABILITY / INDEMNIFICATION AGREEMENT
In consideration of being allowed to participate in programs offered by The Dance Shoppe Ltd. and related events and activities, the undersigned acknowledges, appreciates, and agrees that:
1. Participation includes possible exposure to and illness from infectious diseases including but not limited to MRSA, influenza, and COVID-19. While particular rules and personal discipline may reduce this risk, the risk of serious illness and death does exist; and,
2. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation; and,
3. I willingly agree to comply with the stated and customary terms and conditions for participation as regards protection against infectious diseases. If, however, I observe and any unusual or significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest official immediately; and,
4. I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS The Dance Shoppe Ltd their officers, officials, agents, and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the event ("RELEASEES"), WITH RESPECT TO ANY AND ALL ILLNESS, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF RELEASEES OR OTHERWISE, to the fullest extent permitted by law.
I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IF FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
Release
In part consideration of permitting my child (self) to participate in the activities of The Dance Shoppe Ltd., I agree to ensure my child (self) against any injury or loss resulting from the activities and of traveling to and from these activities. I agree to indemnify and save harmless The Dance Shoppe Ltd. and its employees, agents, and volunteers from all losses, damages, claims, and demands occasioned thereby. I authorize The Dance Shoppe Ltd. and its employees, agents, and volunteers to provide all medical care, which they deem necessary for my child (self) in the event of injury. In Accordance with Ontario's Freedom of Privacy and Information Act, I hereby grant The Dance Shoppe Ltd. permission to videotape my child at the year-end recital and participate in the studio photographs which may be used for promotional purposes. The Dance Shoppe Ltd. will not be responsible for any theft, damage, or injuries during classes or on the location premises.
Cancellations
Cancelling within 30 days of registration or within your first 30 days of classes:
Within 30 days after your registration date and or first 30 days of classes, a refund of the tuition balance only will be made, or future payments will be suspended. Your cancellation request must be received in writing (email) within 30 days of your first class.
Cancelling after your first 30 days of classes:
A cancellation fee of $40 will be charged and the remaining balance will be refunded, or payments suspended.
Cancelling by TDS:
Should the need arise for the studio to ask a parent to withdraw a dancer; a refund of the tuition balance only will be made and or the monthly installments discontinued.
Should The Dance Shoppe be forced to close due to municipal/provincial/federal guidelines at a later date, the following will be applied:
A) TDS will firstly attempt to make up any missed classes. All tuition fees will still be applied in this case.
B) Should TDS not be able to makeup missed classes a credit may be applied to the dancers account to reflect
the amount of tuition for the classes missed. Monthly payments for tuition will be suspended.
C) All other fees are non-refundable and will be evaluated case by case for the possibility of a credit. This
includes but is not limited to costume deposits, birthday party deposits, competitive entry fees etc. These
credits are largely dependent on our suppliers.
Payments
You understand and agree that your payment(s) will be processed using the payment information you have provided to us. The Dance Shoppe will be taking the scheduled payments from the account or credit card provided to us. Monthly payments will be taken initially at the time of registration then continue on the 1st of each subsequent month up to and including June 1st, 2021. Annual payments will be taken at the time of registration or shortly thereafter. Any rejected or declined payments will be processed again at a later date.
