Okanagan Firestorm Waiver and Release
In regards to my child(ren) participating with Okanagan Firestorm Cheerleading Ltd. program(s), I waive any and all claims I may have against and release all liability and agree not to sue Okanagan Firestorm Cheerleading Ltd., Nicole Parrotta, Peter Parrotta, Okanagan Firestorm staff, agents or volunteers for any personal injury, death, property damage or loss sustained as a result of my child's participation in the cheerleading program, arising out of any cause whatsoever.
I am aware of the usual risks and dangers inherent in participation in any of the activities offered through or associated with the Okanagan Firestorm Cheerleading program, including the possibility of injury, death, property damage or loss resulting from these activities. It is my responsibility to ensure my child is wearing suitable clothing during participation in any activities associated with the program: athletic attire/team t-shirts, shorts and cheer shoes for practices and uniform and other items deemed necessary by the coaches. This includes braces and/or athletic equipment that an athlete may be required to wear in order to participate.
My Child and I have read and understand the Okanagan Firestorm Cheerleading policies that apply at all times and are in place as safety protection matters for all program activities. I understand that I must report any injuries to my coach(es) no matter how insignificant they may appear and/or whether or not they were a result of participation with Okanagan Firestorm Cheerleading Ltd.
Accidents can be a result of the nature of the activity and can occur with or without fault on either part of the athlete, Okanagan Firestorm Cheerleading Ltd., it's staff, coaches, agents or the facility where the activity is taking place. By allowing your daughter/son to participate, you are accepting the risk of an accident occurring and agree that the activities carried out in the course of a program event are suitable for your child.
In signing this consent and waiver, I am not relying on any oral or written representation or statements made by Okanagan Firestorm Cheerleading Ltd., its servants, agents, employees or authorized volunteers to induce me to permit my child to take part, other than set out in the consent and waiver. I am 19 years of age or older and have read and understood the terms of this consent and waiver and understand that it is binding upon me, my heirs, executors and administrators. I have legal authority to sign on behalf of my athlete.
BC Cheerleading Waiver and Release
Assumption and Acknowledgement of Risk: I give my consent for my child to participate in cheerleading which may result in personal injury (including but not limited to: injury to bones, joints, ligaments, muscles, tendons, internal organs, and other aspects of the skeletal system and potential impairment to other aspects of the body, and in rare occurrences, death, complete or partial paralysis or brain damage) and property damage or loss. The definition of participating in a cheerleading program includes but is not limited to: an activity that uses organized routines made up of elements from stunting, gymnastics and dance to cheer on sports teams at games and matches or as a competitive sport. I fully understand these risks and hereby agree to give my child permission to participate in a cheerleading program.
Rules: I understand that the rules and regulations are designed for the safety and protection of participants and hereby agree to inform my son/daughter of the importance of abiding by the rules and regulations set down by Okanagan Firestorm Cheerleading Ltd., its coaches and the BC Cheerleading Association.
Liability: In consideration of your acceptance of my child's entry in a BC Cheerleading Association sanctioned event, I, intending to be legally bound, agree to RELEASE, SAVE HARMLESS AND INDEMNIFY both Okanagan Firestorm Cheerleading Ltd. and the BC Cheerleading Association, their Executive and Members, their Organizers and/or agents, heirs and/or spouses from and against all claims, actions, costs and expenses and demands in respect to death, injury, loss or damage to my child's person or property wheresoever and howsoever caused, arising out of, or in connection with their association with or entry in the above sanctioned event or which may arise out of my traveling to or participating in and returning from the said sanctioned event, practice or training session.
I further agree to HOLD HARMLESS Okanagan Firestorm Cheerleading Ltd. and the BC Cheerleading Association, their Executive and Members, their Organizers and/or agents from any and all actions, claims, demands, losses, judgments or costs of any nature to any third party resulting from my child's association or entry in the said sanctioned event and I agree not to make any claims or take any proceedings against any person, society, corporation or other entity who might contribute or indemnify Okanagan Firestorm Cheerleading Ltd. and the BC Cheerleading Association, their Executive and Members, their Organizers and/or agents in respect of matters which are subject of this Release. I agree that this Release shall bind my heirs, executors, administrators and assigns.
I, as the parent/guardian of the participant named herein, agree to assume full responsibility to instruct my child of the risks involved and to inform him/her of the importance of abiding by the rules and regulations.
I, as the parent/guardian of the participant named herein, hereby declare that I have read, understood and agree to the contents of this Informed Consent in its entirety.
Medical Emergencies
In the event of an accident or emergency, I hereby authorize my child(ren) to be transported to a hospital for medical treatment and I hold Okanagan Firestorm Cheerleading Ltd. . and its representatives harmless in the execution of such. Additionally, I hereby agree to individually provide for all medical expenses which may be incurred by me or my child(ren) as a result of an injury sustained while participating at or for Okanagan Firestorm Cheerleading Ltd.
Media Release
Athletes' names and/or pictures may be featured on our Okanagan Firestorm Website and advertisements. By signing this policy form, you give permission for Okanagan Firestorm Cheerleading to use their picture and/or likeness and/or name on public documents like newsletters and websites without payment of any fee or charge, any written information, photograph, video tape or other visual media of my son/daughter taken during an Okanagan Firestorm Cheerleading event or practice session for the purpose of furthering and promoting Okanagan Firestorm Cheerleading Ltd. and the BC Cheerleading Association objectives.
Payment Policy
Refunds: There are NO REFUNDS on Registration / Insurance fees. Tuition cost does not change based on the number/duration of practices in a given month. If an athlete leaves, or is dismissed from a team before the season's end for any reason any and all of their funds are non-refundable. Vacations or time off will not be prorated. All registration, tuition and competition fees are non-refundable/non-transferable. If a class/session is cancelled due to low enrolment, a refund will be issued. There are no refunds on uniform or apparel once ordered.
Cancellation Policy: An early termination or withdrawal from a program unrelated to a Covid-19 forced closure of more than 2 months, must be made in writing. Termination of an athletes season between October 1st 2020 and May 31 2021 will result in a separation fee of one months tuition, as well as payment of the balance of team fees not yet billed that the gym has incurred on behalf of your athlete (including competition entry or choreography fees). This is in addition to any outstanding tuition payments prior to the time of termination. Uniform fees/uniform will be forfeit and applied to outstanding fees.
Late Payments: Payment received late (including uniform and competition deposits) will automatically incur a $10 late fee. Any late payment still outstanding 10 days past the original deadline will incur a $25 penalty. Failure to settle outstanding payments within one month of the original due date will result in penalties that may result in suspension from participating in practices or in extreme cases removal from the routine/program for the remainder of the season.
