PHOTO/MEDIA/EMAIL RELEASE: I give Kats Dance & Twirl Studio the absolute right and permission to use my child’s photograph(s) in its promotional materials and publicity efforts. I understand that the photograph(s) may be used in a publication, print ad, direct-mail piece, electronic media (e.g. video, Internet), or other form of promotion. I release Kats Dance & Twirl Studio, the photographer, their offices, employees, agents, and designees from liability for any violation of any personal or proprietary right I may have in connection with such use. Additionally, I will make no monetary or other claim against Kats Dance & Twirl Studio for the use of the photograph(s)/video(s). Kats Dance & Twirl Studio does not share clients’ personal information with any other company or organization outside of Kats Dance & Twirl Studio owned entities. Kats Dance & Twirl Studio uses client email address provided at the time of registration as a means to communicate important studio details, including but not limited to, studio closures, account related communication, studio related events and news. I provide Kats Dance & Twirl Studio permission to utilize my email in the above-mentioned ways.
ASSUMPTION OF RISK, WAIVER OF LIABILITY AND INDEMNIFICATION AGREEMENT: I am aware that dancing, twirling, tumbling and the exercises associated with it, can place stress on the body, and carry with it the risk of physical injury. On behalf of my child and myself (and if I am no longer a minor, on my own behalf), I assume the risk and agree that Kats Dance & Twirl Studio shall not be liable in any way for injuries sustained during attendance at Kats Dance & Twirl Studio or any of its related functions. Student or Guardian/Parent of Student understand and acknowledge that Kats Dance & Twirl Studio is not insurers of Student’s behavior, actions or participation in the program/classes, and that Kats Dance & Twirl Studio assumes no liability whatsoever for personal injuries or property damages to Student or to third persons arising out of participation in the program activities, classes, or any activities related thereto. Student or Guardian/Parent hereby agree to release, waive, covenant not to sue, indemnify and hold harmless Kats Dance & Twirl Studio, its owners/directors, teachers, employees, or the owners of the location at 404 Enterprise Circle, Louisville, OH 44641, from any and all liability, claims, demands, judgments, actions, executions and causes of action whatsoever. I UNDERSTAND THAT I AM WAIVING MY RIGHT TO TAKE LEGAL ACTION INCLUDING FILING A LAWSUIT FOR PERSONAL INJURIES TO MY CHILD(REN) AND/OR MYSELF.

Kats Dance & Twirl (KDAT), LLC. requires students to have full medical coverage. Signing below indicates you accept insurance responsibility and forever release KDAT, LLC of liability in the unlikely occurrence of injury on the premises during participation.
By checking the box below, you release, discharge, and covenant not to sue KDAT, its respective administrators, directors, agents, officers, volunteers, and employees, other participants, any sponsors, advertisers, and if applicable, owners and lessors of premises on which the Activity takes place, (each considered one of the "Releasees" herein) from all liability, claims, demands, losses, or damages, on my account caused or alleged to be caused in whole or in part by the negligence of the "Releasees" or otherwise, including negligent rescue operations and future agree that if, despite this release, and waiver of liability, I, or anyone on my behalf, makes a claim against any of the "Releasees" I will indemnify, save, and hold harmless each of the "Releasees" from any loss, liability, damage, or cost, which may incur as the result of such claim.
I have read the INSURANCE RELEASE and WAIVER OF LIABILITY and understand that I have given up substantial rights by clicking and accepting these terms and have accepted it freely and without any inducement or assurance of any nature and intend it to be a complete and unconditional release of all liability to the greatest extent allowed by law and agree that if any portion of this agreement is held to be invalid the balance, notwithstanding, shall continue in full force and effect.
Tuition policies: Tuition is due by the 1st of each month. Tuition remains the same whether it’s a long (5 week) or short (3 week) month and regardless of absences, vacations or holidays. There are no makeup classes for holidays, as they are built into the total tuition cost. There is a 10 day grace period for tuition payments to be made before a $15 late fee is applied to the account.
Tuition Payment Options: You may set up your account by linking your checking or savings account to auto-draft on the 1st of the month (ACH) or by credit/debit card which will be auto-charged on the 1st of the month.
Tuition Payment via Credit/Debit Card will be charged with a 2.8% third party processor fee on the 1st of the month. If we are unable to process payment, then a $15 late fee will be assessed immediately.
Competition Fees paid via credit/debit card will be charged the 2.8% third party processor fee.
Tuition Payment by cash or check can be made in person in the studio office. Checks may be postdated no more than 1 week. A $25 non-sufficient funds fee will be added to the account if a check is returned by the bank.
Refunds, adjustments, uncollectable payments: Tuition is non-refundable and non-transferable. There are no refunds or adjustments due to absences or not following through with prior team/recital commitments . Account balances (tuition or fees) will be sent to collections, at client’s expense, if over 60 days past due, and the student will be unenrolled from all KDTS classes.
Past due Payments: Statements will not be mailed out. It is the client’s responsibility to be aware of any and all uncharged items and fees to the account and can be found on the online portal. Client assumes responsibility for awareness of any balance on the account and any late fees. Account balances will be sent to collections, at the client’s expense, if over 60 days past due, and the student will be unenrolled from all KDTS classes.
Accounts set to no autopay: “NO” auto pays: if for any reason, your account is set to no autopay, all the policies above are still in effect and penalty fees will still be added to the account. KDTS is not responsible for fees and tuition left uncharged due to “no” autopay settings. KDTS will not manually process any accounts set to NO autopay, so please be sure to periodically check your account to ensure there are no outstanding charges.
Recital Fees and costume deposits/payments are NON REFUNDABLE for any reason and costumes are not returnable once orders have been placed. The recital fee becomes a cancellation fee should a student drop out after committing to be part of the recital performance.
Private lesson payments: Students will be unenrolled from private lessons if their account is not kept current or they fall behind more than 30 days in private lesson payments.
