Assumption of Risk & Waiver of Liability Re: Covid-19
The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people.
Wilmington Conservatory of Fine Arts, LLC has put in place preventative measures to reduce the spread of COVID-19; however, cannot guarantee that you or your child(ren) will not become infected with COVID-19.
By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COVID-19 by attending Wilmington Conservatory of Fine Arts, LLC and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at Wilmington Conservatory of Fine Arts, LLC may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Wilmington Conservatory of Fine Arts, LLC employees, volunteers, and program participants and their families.
I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with my child(ren)'s attendance or participation in 'Wilmington Conservatory of Fine Arts, LLC 's programs ("Claims"). On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless Wilmington Conservatory of Fine Arts, LLC, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of Wilmington Conservatory of Fine Arts, LLC, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any Wilmington Conservatory of Fine Arts, LLC program.
I agree to not enter Wilmington Conservatory of Fine Arts, LLC for at least 2 weeks (and keep children/participants under age 18 home) if I/they show any symptoms related to COVID-19 (or if exposed to anyone with symptoms of COVID-19 in the last 2 weeks) including (but not limited to): Fever or chills, cough, shortness of breath or difficulty breathing, fatigue, muscle or body aches, headache, new loss of taste or smell, sore throat, congestion or runny nose, nausea or vomiting, or diarrhea.
I agree to follow all the Wilmington Conservatory of Fine Arts, LLC COVID-19 Safety and Health Guidelines and Procedures. Health and Safety procedures can be found at Wilmingtonconservatory.com
Medical Care Release
In the event I cannot be reached, I hereby give my permission to the management, faculty, staff and chaperones of Wilmington Conservatory of Fine Arts to authorize any emergency medical care that may be required by the above student during participation classes, performances, or any related WCFA events. This authorization extends throughout the current academic year and throughout the summer or until the student is no longer enrolled at WCFA, whichever comes first. I understand that I am responsible for any and all charges as a result of such medical treatment.
Financial Payment Agreement
I agree to pay Wilmington Conservatory of Fine Arts for the instruction of the above student per the published tuition rates for the student's period of study. I understand that my credit card will be automatically drafted at the beginning of every month from September 2020-May2021, or from when student begins lessons for monthly tuition. I understand that no refunds will be given for classes missed because of illness, vacation, or school closings due to acts of nature such as inclement weather. I understand that tuition fees are due on the first of the month or on date agreed upon in payment plan. If my student needs to be withdrawn for any reason, I understand that I must turn in a withdrawal notice in writing 30 days in advance or my account will be charged a full month's tuition.
